Since its launch in 2021, the Climate and Environment Charter for Humanitarian Organizations (the Charter) has been signed by hundreds of humanitarian actors across the world, including local and national organizations, United Nations agencies, National Red Cross and Red Crescent Societies, and large international NGOs. The Charter's development grew out of a sector-wide recognition that humanitarians have a role to play in addressing the crises of climate change and environmental degradation, and that fulfilling this role would entail changing how they work. Two years into its existence, the Charter has helped build momentum towards this change and has provided a useful measurement tool for how much remains to be done.

This paper traces the origins, inspiration and process of the Charter from the perspective of the present authors, who co-led the Charter's development. The article highlights some of the challenges that we faced and how these were addressed. In taking stock of progress towards the Charter's goals, the article flags areas where further effort is needed to adequately strengthen the humanitarian response to the climate and environmental crises.

The digital transformation creates significant opportunities and risks for humanitarian action. Current approaches to humanitarian innovation-related issues are too often driven by considerations of competition and relevance, relegating the fundamental humanitarian principles of humanity, impartiality, neutrality and independence to afterthoughts. By reasserting the place and role of these principles in humanitarian decision-making processes, this article argues that it is possible to better understand the political and ethical dimensions of the digital transformation, reverse counterproductive practices, and ultimately better mitigate the negative impact that technologies can have on the safety and dignity of people affected by humanitarian crises, and on principled humanitarian action.

Le 15 juin 1998 s'ouvrira à Rome une Conférence diplomatique chargée de combler une des lacunes qui existe depuis longtemps dans le système de mise en œuvre du droit international humanitaire. Cette Conférence, qui durera cinq semaines, devrait aboutir à l'adoption d'une convention portant création d'une cour criminelle internationale permanente. Même si la volonté qui s'exprime actuellement au sein des Nations Unies en vue d'instaurer une cour permanente s'est manifestée pour la première fois il y a cinquante ans—il s'agit de la proposition présentée en 1947 par Henri Donnedieu de Vabres, juge français au Tribunal militaire international de Nuremberg—, on ignore encore souvent que la première proposition sérieuse en ce sens aurait été faite il y a plus de 125 ans par Gustave Moynier, un des fondateurs du Comité international de la Croix-Rouge, qu'il a longtemps présidé.

L'Institut international de droit humanitaire a tenu les 13 et 14 septembre 1989, à San Remo, la XIVe Table Ronde sur le droit international humanitaire. Cette Table Ronde portait sur le théme des «régles du droit international humanitaire relatives à la conduite des hostilités dans les conflits armés non internationaux».

L'action pénale contre les personnes accusées d'avoir commis des crimes de guerre est un aspect fondamental du droit d'une victime à la justice. Toutefois, dans les conflits armés où des violations graves du droit international ont été perpétrées massivement, il est souvent nécessaire d'établir un équilibre entre le droit des victimes à obtenir justice de manière tangible et le besoin, pour l'Ètat territorial, de traiter les atrocités passées de façon à ne pas engendrer de nouvelles violences et à stimuler le processus de réconciliation. Dans de telles circonstances, une justice réparatrice associant des amnisties limitées à d'autres mécanismes de responsabilité peut constituer un moyen d'assurer l'État de droit tout en tenant compte de la complexité du processus de transition. Quand des États vivant une situation de transition prodament de telles amnisties, il est important d'établir si celles-ci seront reconnues par la communauté internationale.

Cet article analyse les règies et les principes internationaux qui fondent ou étayent la décision que prend un tribunal national ou international de reconnaître ou non une amnistie couvrant les crimes de guerre. l'auteur s'attache d'abord à déterminer s'il existe un devoir coutumier de traduire en justice les personnes accusées de crimes de guerre, quels qu'ils soient. Les effets du caractère de jus cogens de l'interdiction de commettre des crimes de guerres sont égakment examinés, tout comme la pratique plus récente des États d'établir des tribunaux spéciaux pour juger les personnes accusees de crimes de guerre. L'article fait valoir que le droit international n'interdit pas aux tribunaux nationaux et internationaux d'accorder une amnistie limitée à ceux qui sont considérés comme «les moins responsabks » de la commission des crimes de guerre, lorsque l'amnistie est associée à des mesures de contrôle et vise à faciliter l'instauration d'une paix durable.

In Afghanistan, rule of law projects have placed a heavy emphasis on rebuilding courts and law enforcement institutions. Little attention has been given to the critical element of defence, particularly criminal defence services for the poor. Yet, without defence lawyers, there can be no rule of law. This article examines the right to counsel in Afghanistan and the indispensable role that defence lawyers are playing in the development of the justice system, illustrated by the experience of the International Legal Foundation. By providing early and effective representation to their clients, lawyers ensure that Afghanistan's new laws and constitutional provisions protecting the rights of the accused are implemented.

To ensure that it is respected, international humanitarian law (IHL) requires mechanisms for its implementation. Most of these are known and have proved their worth, whether as means of prevention, control or repression. They do however have their limitations and, in this sense, the International Fact-Finding Commission provided for in Article 90, Protocol I, fills a gap.

The ICRC Medical Division, established in November 1977, works for the war wounded, for prisoners, for the civilian population and for the war disabled. Its essential purpose is to keep the victims alive, alleviate their suffering and prevent their sicknesses or wounds from ruining the rest of their lives.

In his summary of ICRC activities during his term of office, (1976–1987) President Alexandre Hay said last May, “The medical sector, completely embryonic when I arrived, has developed considerably and has now achieved a highly praiseworthy quality and dimension. The ICRC and the victims of conflicts owe a great deal to the spirit of initiative, devotion and competence of its doctors”.

The Review is particularly pleased to publish the following article by Dr. Remi Russbach, Chief Medical Officer of the ICRC, who traces the evolution of the Medical Division in the past ten years, emphasizing not only the progress achieved in the execution of its programmes but dealing as well with the problems which the ICRC has had to face in this domain.

The regional delegate of the International Committee of the Red Cross (ICRC) for Southern Africa was in Angola from 9 to 26 October 1974. He was received by Vice-Admiral Antonio Rosa Coutinho, president of the Angolan Military Junta, and General Altino de Magalhães, chief military commander. He also met the president and members of the Red Cross in Angola.

C'est par ces actes mêmes qu'ils manifestaient concrètement la vertu d'humanité, si profondément enracinée au sein du peuple japonais, depuis la plus haute antiquité. II semblerait, néanmoins, que l'organisation de programmes de secours établis sous l'égide d'une organisation dûment constituée, comme le prescrit, par exemple, la Convention de Genève, n'eut lieu que depuis l'époque des Meiji, ou pour être plus précis, depuis le Ier mai 1877, lorsque fut constituée la Hakuai-sha (Société d'humanité) qui a précédé l'actuelle Société nationale de la Croix-Rouge au Japon.
