La LXII Conferencia Interparlamentaria, reunida en Londres el mes de septiembre de 1975, aprobó una resolutión cuyo párrafo II alude al Protocolo de Ginebra de 1925, que es este:

La LXII Conferencia Interparlamentaria insta a todos los Estados, en particular a los que ya disponen de estas armas, a que hagan lo posible para conseguir una prohibición y la destrucción efectiva de las armas químicas, incluidas las armas para las cuales se utilizan las nuevas técnicas binarias, y además para garantizar un control internacional satisfactorio con miras a la prohibición de la puesta a punto, de la fabricación y del almacenamiento de armas químicas;

As a post-war emergency assistance operation, the ICRC, at the end of February, submitted to the Government of the People's Republic of Angola (RPA) a six-month medico-social programme to supplement the humanitarian activities which it had been carrying on for several months. In a letter on 13 April, the Angolan Prime Minister, Mr. Lopo do Nascimento, informed the ICRC of the Angolan Government's wish for assistance programmes for the Angolan people to be conducted by national agencies and particularly through the National Red Cross Society which was then being organized.

The founders of the Red Cross did not seek to establish their work on the elements of a doctrine. They referred to a concept of the world which was common to them all and which did not appear to need any explanation. They were impelled by the emotions which Henry Dunant's revelations and proposals had raised in them. Their purpose was to “take into serious consideration the idea proposed in the conclusions of the book entitled “A Memory of Solférino”, namely the foundation of Societies for the Relief of Wounded Soldiers and the addition of a corps of medical volunteers to the belligerent armies”, and their concern was “how” to put that idea into practice rather than “why”. It is true that those conclusions contained in embryo a whole set of guiding principles which were not formally stated until much later; but they appeared then as a necessary condition for the application of the initial decisions rather than as their source.

The part played by army medical officers in the beginnings of the humanitarian movement that led to the foundation of the Red Cross 125 years ago is all too often unrecognized. Until the foundation of societies for the relief of the wounded brought their names into the limelight, their writings were hardly known outside their small professional circle, although they had taken part in international exchanges that were in themselves remarkable. Their position was made all the more difficult by their feeling bound to protest at the shortcomings of a service of which they were active members, but in whose decisions they had no voice.

Les Conventions de Genève du 12 août 1949 prévoient comme moyen général d'identification du personnel et du matériel sanitaires le signe distinctif de la croix rouge ou du croissant rouge. La IIe Convention de Genève, applicable aux victimes des conflits sur mer, précise en plus la couleur blanche pour les surfaces extérieures des navires hôpitaux et embarcations sanitaires et elle recommande aux parties en conflit d'utiliser «les méthodes les plus modernes” pour faciliter l'identification des moyens de transport sanitaires maritimes (article 43).

La cuestión de las órdenes superiores es objeto de una abundante literatura. Dada la complejidad del problema, no hay una respuesta sencilla. Según el derecho nacional aplicable, el militar que se niega a ejecutar una orden es pasible de condena penal. Los códigos penales militares prevén en general para los casos graves, especialmente en situación de guerra, que el juez podrá dictar la pena de muerte. Ahora bien, el hecho de haber ejecutado la orden de un superior, que viole el derecho internacional humanitario, no exime, de por sí, la responsabilidad penal del militar subordinado.

Es conveniente, pues, examinar la antinomia de los principios: disciplina-responsabilidad. Examinaremos, en primer lugar, la evolución de ese problema a partir del proceso de Nuremberg.

Los problemas que plantean las minas antipersonal, especialmente en Camboya, Afganistán, Kuwait y Angola, por solo citar los países donde hay esparcidas cantidades considerables de ellas y, además, en regiones en que representan un peligro para la población civil, incluso mucho después de terminadas las hostilidades, nos han llevado a interesarnos más de cerca por este problema.

The work of the Red Cross in the Congo — The International Committeee of the Red Cross has continued to assist persons under detention in the Congo, by visiting on March 1 the eight Belgian soldiers who were taken prisoner in January after crossing the Congo frontier, coming from Ruanda-Urundi. The delegate of the ICRC was allowed to speak with them, to hand over correspondence and to give them a few comforts.

The purpose of this study is to analyse the normative character of custom in international humanitarian law (IHL), on the basis of the theory and jurisprudence of public international law, in order to arrive at a better understanding of the conduct of States in conflict situations. In so doing, an attempt will be made to determine the possibilities for developing custom in IHL, especially in view of the increasing concern shown by international public opinion for the plight of victims of armed conflicts. The paper will begin with a review of the questions raised by custom as an independent source of humanitarian law (point 1) and go on to take a closer look at the constituent elements of custom in humanitarian law (point 2). It will end with a comparative study of the two approaches to custom in IHL, concentrating on the consequences that the development of custom may have in the future (point 3).

La Croix-Rouge internationale a tenu ses assises à Istanbul, du 6 au 13 septembre 1969. Pas moins de 610 délégués, représentant 77 Etats et 83 Sociétés nationales de la Croix-Rouge (Croissant-Rouge, Lion-et-Soleil-Rouge) ainsi que 51 observateurs se sont réunis dans le beau Palais de la Culture, tout juste achevé. Favorisée par le généreux accueil des hautes autorités du pays, organisée par le Croissant-Rouge turc, avec le concours des institutions internationales de la Croix-Rouge, la XXIe Conférence fut présidée par M. Riza Cerçel, président du Croissant-Rouge. Celui-ci demanda à Lady Limerick, présidente de la Commission permanente, d'assumer la direction effective de la majeure partie des débars. L'un et l'autre s'acquittèrent avec distinction de leur tâche délicate.

La requête présentée par l'Assemblée générale des Nations Unies, dans la résolution 49/75 K (1994), pour que la Cour internationale de Justice (CIJ) donne un avis consultatif sur la question «Est-il permis en droit international de recourir à la menace ou à l'emploi d'armes nucléaires en toute circonstance ?» a fourni à celle-ci une occasion exceptionnelle de se pencher sur les principes du droit international humanitaire. La Cour se serait d'ailleurs peut-être bien passée de cette occasion. Car la question n'était pas bien formulée, et les raisons de la poser étaient tout à fait insatisfaisantes. Sa nature, forcément abstraite, a notamment mis la Cour dans une situation extrêmement difficile, parce qu'il lui était impossible d'envisager toutes les combinaisons de circonstances dans lesquelles les armes nucléaires pouvaient être employées ou menacées de l'être. Pourtant, à moins d'être d'avis que cet emploi est toujours licite (ce qui bien entendu est absurde), qu'il ne relève aucunement du droit (ce qu'aucun État n'a suggéré) ou qu'il est toujours illicite (opinion soutenue par certains mais que la Cour a rejetée, à juste titre), la réponse à la question de l'Assemblée générale ne pouvait que dépendre d'un examen minutieux de ces circonstances.
