Most of the provisions of the 1977 Protocols to the Geneva Conventions are applicable only in time of armed conflict.

However, there are two types of provisions which may require States Parties to the Protocols to adopt certain measures upon ratification or accession, that is to say already in peacetime. These are:

— provisions which lay down a standing obligation, such as Article 83 of Protocol I and Article 19 of Protocol II, relating to dissemination of the Protocols;

— provisions which need to be supplemented by domestic legislation or regulations, or which require practical action to be taken at an early stage so that they may be applied when the need arises.

The purpose of this study is to analyse the normative character of custom in international humanitarian law (IHL), on the basis of the theory and jurisprudence of public international law, in order to arrive at a better understanding of the conduct of States in conflict situations. In so doing, an attempt will be made to determine the possibilities for developing custom in IHL, especially in view of the increasing concern shown by international public opinion for the plight of victims of armed conflicts. The paper will begin with a review of the questions raised by custom as an independent source of humanitarian law (point 1) and go on to take a closer look at the constituent elements of custom in humanitarian law (point 2). It will end with a comparative study of the two approaches to custom in IHL, concentrating on the consequences that the development of custom may have in the future (point 3).

La cuestión de las órdenes superiores es objeto de una abundante literatura. Dada la complejidad del problema, no hay una respuesta sencilla. Según el derecho nacional aplicable, el militar que se niega a ejecutar una orden es pasible de condena penal. Los códigos penales militares prevén en general para los casos graves, especialmente en situación de guerra, que el juez podrá dictar la pena de muerte. Ahora bien, el hecho de haber ejecutado la orden de un superior, que viole el derecho internacional humanitario, no exime, de por sí, la responsabilidad penal del militar subordinado.

Es conveniente, pues, examinar la antinomia de los principios: disciplina-responsabilidad. Examinaremos, en primer lugar, la evolución de ese problema a partir del proceso de Nuremberg.

Il n'y a guère d'Etats qui n'aient pas traversé, au cours de leur histoire, des périodes d'insécurité et de contestation accompagnées de violence.

The United States considers many provisions of Protocol I additional to the Geneva Conventions of 1949 to be either statements of customary international law or to reflect what that law should be. It is in that vein that the United States views Article 90 on the International Fact-Finding Commission. The U.S. Joint Chiefs of Staff (JCS) military analysis of the Protocols expressed the views of the U.S. Department of Defense on Article 90 as follows:

“One major innovation of the Protocol is the creation of a permanent 15-member International Fact-Finding Commission to investigate alleged grave breaches or serious violations of the Protocols and the Conventions and to facilitate, through its good offices, the restoration of an attitude of respect for the Conventions and [the] Protocol”.

La torture, par laquelle «une douleur ou des souffrances aiguës, physiques ou mentales, sont intentionnellement infligées à une personne», a surtout pour objectif l'extorsion de renseignements et d'aveux, mais aussi l'intimidation et l'avilissement, et enfin la punition — illegitime — pour un acte que la personne a réellement commis ou qu'elle est soupçonnée d'avoir commis. Les techniques de torture comprennent la privation de nourriture et de sommeil, l'alternance abrupte du froid et du chaud, du silence et du bruit, l'isolement total, le manque d'information, le fait d'induire en erreur, l'emploi de la force brutale contre le corps jusqu'à la mutilation durable, la menace de mort, l'agression sexuelle, l'usage de l'électricité ou le recours à des produits chimiques et pharmaceutiques.

The Office of the United Nations High Commissioner for Refugees (UNHCR) was set up in 1951 with the main function of providing protection for refugees. This mandate corresponded to the task immediately confronting it, that of solving the refugee problem affecting Europe in the aftermath of the Second World War.
