Le CICR s'interroge depuis longtemps sur le comportement des combattants en temps de guerre, en particulier sur les paramètres qui interviennent dans le respect ou la violation des normes élémentaires du droit des conflits armés. La violence inhérente à la guerre induit-elle nécessairement une montée aux extrêmes? La guerre est-elle par définition criminogène? Est-elle inéluctablement accompagnée d'un cortège d'atrocités ?

Desde 1976, la Liga tiene nuevos Estatutos. Fueron necesarios cuatro años de estudios, investigaciones y deliberaciones para que una comisión especial, instituida el año 1973 por el Consejo de Gobernadores, ultimase, con la participación activa de las Sociedades nacionales, miembros de la Liga, la elaboración de la nueva Carta de la Liga para los próximos años.

Era muy importante lo que estaba en juego, y las Sociedades nacionales no se equivocaron cuando decidieron, en 1973, efectuar una revisión total de los Estatutos, lo que no se habóa hecho desde 1938, época en que la Liga tenía menos de sesenta miembros.

Se trataba de probar, nada menos, que la Liga, al igual que el movimiento de la Cruz Roja, es una institución dinámica, capaz de adaptarse a los grandes cambios registrados después de la Segunda Guerra Mundial en la comunidad international y en la Cruz Roja, que está habilitada para responder a las necesidades y a las aspiraciones de las comunidades y para guiar la evolutión de sus miembros, las Sociedades nacionales.

The founders of the Red Cross did not seek to establish their work on the elements of a doctrine. They referred to a concept of the world which was common to them all and which did not appear to need any explanation. They were impelled by the emotions which Henry Dunant's revelations and proposals had raised in them. Their purpose was to “take into serious consideration the idea proposed in the conclusions of the book entitled “A Memory of Solférino”, namely the foundation of Societies for the Relief of Wounded Soldiers and the addition of a corps of medical volunteers to the belligerent armies”, and their concern was “how” to put that idea into practice rather than “why”. It is true that those conclusions contained in embryo a whole set of guiding principles which were not formally stated until much later; but they appeared then as a necessary condition for the application of the initial decisions rather than as their source.

Les Conventions de Genève du 12 août 1949 prévoient comme moyen général d'identification du personnel et du matériel sanitaires le signe distinctif de la croix rouge ou du croissant rouge. La IIe Convention de Genève, applicable aux victimes des conflits sur mer, précise en plus la couleur blanche pour les surfaces extérieures des navires hôpitaux et embarcations sanitaires et elle recommande aux parties en conflit d'utiliser «les méthodes les plus modernes” pour faciliter l'identification des moyens de transport sanitaires maritimes (article 43).

La Conferencia Diplomática sobre la reafirmación y el desarrollo del derecho internacional humanitario aplicable en los conflictos armados ha reanudado sus trabajos en Ginebra el 21 de abril de 1976, bajo la presidencia del Sr. Pierre Graber, Consejero Federal, Jefe del Departamento Político Federal.

Este tercer período de sesiones es la continuación de los períodos de sesiones primero y segundo, que se celebraron también en Ginebra del 20 de febrero al 29 de marzo de 1974, y del 3 de febrero al 18 de abril de 1975, respectivamente.

Al abrir la 31a sesión plenaria, el Presidente saludó a los delegados de los Estados participantes en la Conferencia. Después de señalar que la mitad de los artículos de los proyectos de Protocolos adicionales a los Convenios de Ginebra de 1949 ya han sido aprobados por las Comisiones, el Sr. Graber precisó que todavía quedan por resolver difíciles problemas, por lo que hizo un llamamiento para que se dé muestras de una voluntad de cooperación semejante a la que animó los trabajos del segundo período de sesiones.

The part played by army medical officers in the beginnings of the humanitarian movement that led to the foundation of the Red Cross 125 years ago is all too often unrecognized. Until the foundation of societies for the relief of the wounded brought their names into the limelight, their writings were hardly known outside their small professional circle, although they had taken part in international exchanges that were in themselves remarkable. Their position was made all the more difficult by their feeling bound to protest at the shortcomings of a service of which they were active members, but in whose decisions they had no voice.

At the invitation of the International Committee of the Red Cross, plenipotentiary representatives of the Yugoslav Federal Executive Council, the Republic of Croatia, the Republic of Serbia and the Federal Army met in Geneva on 26 and 27 November 1991 to find solutions to the various matters of humanitarian concern arising from the conflict in Yugoslavia. The meeting gave substance to the declaration of respect for international humanitarian law made by the Presidents of the six Republics in The Hague on 5 November.

The response of the international community to the massacres and genocide in Rwanda was at times “reluctant” and “inadequate”. This can partly be explained by the amount of human and material resources that would have been required to restore peace and address the more fundamental issues of the failure of the State itself. The Rwandan experience does, however, also raise serious questions about the adequacy of international and regional structures responsible for maintaining and restoring peace.

Suite aux allégations mettant en cause quelques-uns de ses délégués pendant la Seconde Guerre mondiale, parues dans la presse au cours de l'été 1996, le CICR s'était engagé à faire toute la lumière sur cette période de son passé. Ces allégations étaient fondées sur un certain nombre d'observations enregistrées par des agents de l'Office of Strategie Services (OSS) américain; elles laissaient entendre que des délégués avaient eu un comportementpeu compatible avec le mandat humanitaire du CICR.
