In spite of its dominance, there are well-known problems with Rawls’s method of reflective equilibrium (MRE), as a method of justification in meta-ethics. One issue in particular has preoccupied commentators, namely, the capacity of this method to provide a convincing account of the objectivity of our moral beliefs. Call this the Lack-of-Objectivity Charge. One aim of this article is to examine the charge within the context of Rawls’s later philosophy, and I claim that the lack-of-objectivity charge remains unanswered. A second aim of this article is to examine the extent to which, despite Rawls’s express intention to avoid reliance on Kant’s moral philosophy, supplementing Rawls’s political constructivism with some Kantian elements, in particular Kant’s idea of a universal principle of right, not only addresses some of the issues raised by the lack-of-objectivity charge, but also does so without compromising the ability of the Rawlsian account to accommodate the pluralism of conceptions of the good, which he takes to be a fact of modern democracies. I argue for a revised justificatory methodology, which combines Rawls’s MRE and Kant’s Critical Method.

Kant deploys analogies from private law in describing relations between states. I explore the relation between these analogies and the broader Kantian idea of the distinctively public nature of a rightful condition, in order to explain why states, understood as public things, stand in horizontal, private legal relations without themselves being private. I use this analysis to explore the international law analogues of the three titles of private right, explaining how territory differs from property, treaty from contract and the specific form of status relations between nations. I conclude with a brief discussion of the ongoing relevance of these horizontal relations.

This article reconstructs Jean-François Lyotard’s theory of the sublime in contemporary art, focusing on his claim that such art ‘presents’ the unpresentable, and tracing its origins in Kant’s account of the sublime. I propose that Lyotard identifies a difficulty concerning Kant’s account: to understand why the disparate elements in the experience of the sublime (idea of reason, sensible representation) should be synthesized to form that experience. Lyotard recasts this difficulty as a pragmatic problem for artistic practice – how to ‘testify’ to the absolute in a non-absolute, sensibly perceivable object (the artwork) – that can be understood to drive avant-garde artistic experimentation.

A philosophically and historically influential section of the Critique of Judgement presents an ‘intuitive intellect’ as a mind whose representation is limited to what actually exists, and does not extend to mere possibilities. Kant’s paradigmatic instance of such an intellect is however also the divine mind. This combination threatens to rule out the reality of the mere possibilities presupposed by Kant’s theory of human freedom. Through an analysis of the relevant issues in metaphysical cosmology, modal metaphysics and philosophical theology, I show that Kant in fact possesses the resources to reconcile the philosophical claims of §76 of the Critique of Judgement with his keystone commitment to the reality of human freedom.

In an interview with Philippe Nemo, Emmanuel Levinas makes a very revealing comment about what he was trying to accomplish in his ethical philosophy. In response to a question about the ‘starting-point’ of his ethics, Levinas protests: ‘My task does not consist in constructing ethics; I only try to find its meaning … One can without doubt construct an ethics in function of what I have just said [in describing his philosophy up to this point in the interview], but this is not my own theme’ (El 95–9/90).

My aim in this article is to provide an account of practical judgement, for Kant, that situates it within his theory of judgement as a whole – particularly, with regards to the distinction between the determining and reflecting use of judgement. I argue that practical judgement is a kind of determining judgement, but also one in which reflecting judgement plays a significant role. More specifically, I claim that practical judgement arises from the cooperation of the reflecting power of judgement with the faculty of reason – the former assisting the latter in the application of its principle. I conclude by considering a possible role for feeling in practical judgement.

It is widely supposed that the principal task of Kant's Critique of Pure Reason is to carry out some kind of analysis of experience. Commentators as profoundly at odds on fundamental points of interpretation as P. F. Strawson and Patricia Kitcher share this supposition. In a letter to J. S. Beck, Kant seems to endorse this view himself, referring to some unspecified stretch of the Critique as an ‘analysis of experience in general’. The idea that the Critique is engaged in an analysis of experience accords well with an attractive conception of Critical philosophy as making something explicit that is generally only implicit in our cognitive lives. After all, the categorical imperative is no innovation of Kant's practical philosophy, but rather is meant to be revealed as the animating principle of ‘ordinary moral rational cognition’. Likewise, the principles revealed in Kant's theoretical philosophy should be nothing other than the principles that necessarily animate ordinary empirical cognition; and Kant says that experience is, or is a mode of, empirical cognition. For this reason, it is undeniably compelling to think of the Critique as offering some kind of analysis of experience.

I propose that we interpret Kant’s argument from incongruent counterparts in the 1768 article ‘Concerning the Ultimate Ground of the Differentiation of Directions in Space’ in light of a theory of dynamic absolute space that he accepted throughout the 1750s and 1760s. This force-based or material conception of space was not an unusual interpretation of the Newtonian notion of absolute space. Nevertheless, commentators have continually argued that Kant’s argument is an utter failure that shifts from the metaphysics of space to its epistemology, because he has no way to connect ‘directionality’ and ‘handedness’ to absolute space. This supposed failure is based on an understanding of absolute space in purely mathematical terms and as an absolute void that lacks any qualitative or dynamic features. If we recognize that Kant held that space had an intrinsic directional asymmetry then his argument successfully connects incongruent counterparts to absolute space. The presence of this notion in Kant’s pre-Critical thought is rarely noted, and its necessity in understanding his incongruence argument is novel.

Kant’s anthropological lectures introduce scepticism about our psychological capacity to experience happiness conceived as gratification or contentment. Aesthetic experience is in a position to inform an alternative conception of happiness that not only is more adequate to the idea of happiness than either gratification or contentment but also may more easily conform to the moral law’s constraints than gratification. As an ‘ideal feeling’, pleasure in beauty serves as a model for how best to enjoy even sensual pleasures and otherwise ‘private’ sensations. In the end, the third Critique suggests that this alternative conception is more ‘appropriate’ to humankind (§60, 5: 355).

This article explores the practical approach to global justice advocated by the cosmopolitan political theorists Pogge, Beitz and Buchanan. Using a comparative exposition it outlines their reliance on international law and on human rights law in particular. The essay explores the neo-Kantian influence on the practical approach and offers an original critique of this trend in contemporary international political theory.

Recently, a number of Kantians have argued that despite Kant’s own disparaging comments about same-sex intercourse and marriage, his ethical and legal philosophy lacks the resources to show that they are impermissible. I go further by arguing that his framework is in fact more open to same-sex than to different-sex marriage. Central is Kant’s claim that marriage requires equality between spouses. Kant himself thought that men and women are not equal, and some of his more insightful remarks on the issue reveal that he was also aware that, as a matter of fact, women were disenfranchised by society, and suffer legal and other forms of discrimination. Kant, according to his own account, cannot approve of heterosexual marriage. Same-sex couples, by contrast, can satisfy the crucial equality condition. I conclude with a suggestion for refocus with respect to the issues at hand, calling for attention to more complex and insidious forms of inequality than deprivation of rights and full civil participation.

In this article I press four different objections on Forst’s theory of the ‘Right to Justification’. These are (i) that the principle of justification is not well-formulated; (ii) that ‘reasonableness and reciprocity’, as these notions are used by Rawls, are not apt to support a Kantian conception of morality; (iii) that the principle of justification, as Forst understands it, gives an inadequate account of what makes actions wrong; and (iv) that, in spite of his protestations to the contrary, Forst’s account veers towards a version of moral realism that is prima facie incompatible with Kantian constructivism. I then evaluate Forst’s theory in the light of a distinction made by Sharon Street between restricted and unrestricted constructivism. I show that Forst has reason to deny that it is either the one or the other, but he is not able to show that it is both or neither. I conclude that the arguments Forst advances in support of his constructivist theory of the right to justification entail that it is a metaphysical and comprehensive conception in the relevant, Rawlsian sense. Forst’s theory of the right to justification therefore fails to fulfil one of the main stated aims.

Kant’s practical philosophy, Rawls’s theory of justice and contemporary human rights thinking are landmarks in liberal discussions of justice. Each forms part of a powerful tradition of political thought, and although their substantive accounts of justice diverge at many points, they also overlap in substantial ways. This article focuses not on their substantive claims about justice, or about other ethical standards, but on their differing views of the questions to be addressed, on their proposed justifications for standards of justice, and on a limited range of questions about interpreting and institutionalizing those standards.

It is commonly thought that the distinction between subjectively valid judgements of perception and objectively valid judgements of experience in the Prolegomena is not consistent with the account of judgement Kant offers in the B Deduction, according to which a judgement is ‘nothing other than the way to bring given cognitions to the objective unity of apperception’. Contrary to this view, I argue that the Prolegomena distinction maps closely onto that drawn between the mathematical and dynamical principles in the System of Principles: Kant’s account of the Prolegomena distinction strongly suggests that it is the Analogies of Experience that make it possible for judgements of perception to give rise to judgements of experience. This means that judgements of perception are objectively valid with regard to the quantity and quality of objects, and subjectively valid with regard to the relation they posit between objects. If that is the case, then the notion of a judgement of perception is consistent with the B Deduction account of judgement.
