Gracias a un donativo efectuado el año 1982 por el señor Paul Reuter, profesor emérito de Derecho, Economía y Ciencias Sociales de la Universidad de París, así como miembro y ex presidente de la Comisión de Derecho Internacional de las Naciones Unidas, el CICR creó el Fondo Paul Reuter, cuyas rentas deben utilizarse para fomentar la difusión del derecho internacional humanitario. Este fondo sirve también para asignar, cada dos años en principio, un Premio Paul Reuter de 2.000 francos suizos a fin de recompensar una obra particularmente meritoria en el ámbito del derecho internacional humanitario.

El jurado que otorgó el premio, presidido por el profesor Jean Pictet, vicepresidente de honor del CICR, estuvo integrado, en esta ocasión, por los profesores L. Condorelli y G. Malinverni, de la Universidad de Ginebra, además de los representantes de la administratión del CICR, decidió asignar por primera vez el Premio Paul Reuter al señor Mohamed El Kouhene, doctor en derecho, de nacionalidad marroquí, por su tesis titulada «Las garantías fundamentales de la persona en los instrumentos de derecho humanitario y de los derechos humanos», que defendió, el mes de julio de 1984, en la Facultad de Derecho de la Universidad de Niza.

Au moment où tant de drames se jouent en tant de points du globe, je ne pense pas que votre Commission se contenterait d'un exposé technique sur la nature et les conditions de l'assistance humanitaire. Un tel exposé paraîtrait inutile, car il serait hors du contexte d'une réalité tragique. Pensons à ce qui se passe au Liban, aux combats de grande envergure qui pourraient reprendre incessamment sur le Planalto, en Angola, au sort des populations afghanes et khmères, pour ne citer que ces cas-là.

The growing and intensified manifestations of religion in politics and vice versa are part of the environment of ICRC operations in Muslim countries and mark especially the interaction with Islamists. Different perceptions held by Muslims are examined, problem areas regarding interaction with the ICRC are analysed and aspects are mentioned which, in the opinion of the author, can help the ICRC improve its activities in Muslim countries. The conclusions of the examination could be relevant in any relationship with conservative movements within other religions.

If we look back to the diverse origins of the laws of warfare, one basic question which seems to have occupied the early lawmakers was: why, in fact, should there be legal limitations to belligerent actions aimed at destroying a foreign foe? At first glance, any such constraints would appear to be contrary to the very purpose of warfare and thus of no value to those who were either forced to resist an armed attack or who themselves wished to wage war against an enemy.

Tal es el lema de este Día Mundial de la Cruz Roja y de la Media Luna Roja que se celebra en todo el mundo, hoy, 8 de mayo de 1991, fecha aniversario del nacimiento de nuestro fundador, Henry Dunant, y que es este año el punto culminante de una Campaña Mundial para la Protección de la Víctimas de la Guerra.

La guerra y la violencia continúan asolando grandes regiones en el mundo. En este mismo momento, más de 30 conflictos causan estragos: son millones de personas muertas, heridas, encarceladas o condenadas a huir de su hogar o de su país.

Son muchos los Estados que han debido afrontar, a lo largo de su historia, situaciones de disturbios interiores y tensiones internas, tan graves a veces que hicieron peligrar sus intereses esenciales. Esas situaciones, que se caracterizan por actos de rebelión y de violencia cometidos por facciones más o menos organizadas contra las autoridades, o entre las propias facciones, se distinguen de las calificadas como conflictos armados no intemacionales, en que la intensidad de tales actos es mayor. Para poner fin a esos enfrentamientos y restablecer el orden perturbado, las autoridades se sirven, con frecuencia de considerables efectivos policiales e, incluso, de las fuerzas armadas. Esto da necesariamente lugar a una alteración del estado de derecho, caracterizada por graves violaciones en gran escala de los derechos humanos, que causan sufrimientos generalizados entre la población.

The work of the Red Cross is born of a high ideal, from which it continually draws fresh life, but as it primarily consists of practical actions, frequently improvised, there is a serious risk that in the haste of charitable action and in spite of the purity of one's intentions, one may deviate from the guiding principles and unity of thought may diminish, the more so as the institution takes root in every corner of the world. It is therefore particularly necessary that the Red Cross possesses a well-defined and firmly established doctrine.

Over the years the Americas have made significant contributions to the development of international humanitarian law. These include three nineteenth-century texts which constitute the earliest modern foundations of the law of armed conflict. The first is a treaty, signed on 26 November 1820 by the liberator Simón Bolívar and the peacemaker Pablo Morillo, which applied the rules of international conflict to a civil war. The second is a Spanish-American work entitled Principios de Derecho de Genres (Principles of the Law of Nations), which was published in 1832 by Andrés Bello. This work dealt systematically with the various aspects and consequences of war. The third is a legal instrument, signed on 24 April 1863 by United States President Abraham Lincoln, which codified the first body of law on internal conflict under the heading “Instructions for the Government of Armies of the United States in the Field” (General Orders No. 100). This instrument, known as the Lieber Code, was adopted as the new code of conduct for the armies of the Union during the American Civil War.

Mounting an effective international humanitarian response to a chemical, biological, radiological or nuclear (CBRN) event, especially if the response is undertaken on an ad hoc basis, would be extremely difficult and would pose many risks to the responders. The International Committee of the Red Cross (ICRC) has created a competency-based capacity to respond to at least small-scale CBRN events, including a deployable capability to undertake operational activities. This involves informed assessments of CBRN risks, timely and competent decisions on how to respond, and effectively mobilizing appropriate resources to implement these decisions, through the creation of an emergency roster. In addition to the acquisition of technical expertise and material resources, the creation of such capacity requires the application of central processes, ensuring systematic management of CBRN response (including risk-based decision-making), standing operational procedures, and availability of and access to the necessary resources. Implementation of the ICRC's CBRN response framework as described in this article should be considered by any agency or other stakeholder preparing for international humanitarian assistance in CBRN events – especially if such events are related to armed conflict.

The National Lifeboat Societies and State-maintained rescue services, members of the International Lifeboat Conference (ILC), unanimously adopted the report by their special working group on the protection of rescue craft in periods of armed conflicts. The report was drawn up after the meeting in Geneva from 16 to 18 April 1984 of that working group, comprising representatives of the ILC, of the International Maritime Organization (IMO), of the International Telecommunication Union (ITU) and of the International Committee of the Red Cross (ICRC). It contains recommendations for improving the protection of rescue craft and their crews and of fixed coastal installations and staff of lifeboat institutions in periods of armed conflict.
