Roeland Duco Kollewijn was born in Amsterdam, on december 7, 1892, a son of Dr. Roeland Anthony Kollewijn, the well known protagonist of a simplified orthography of the Dutch language.

I do not know what his parents initially had in mind for his future. As a matter of fact they made him follow a type of secondary school, which did not—and still does not—qualify its pupils for the academic study of the humanities, the very study of which his father was a destinguished representative. It is said that young Kollewijn at that time saw himself as a future architect but that his father denied him the indispensable vein of fantasy for that calling. Be this as it may, immediately after finishing the secondary school in 1910, Roeland Duco started preparing for a supplementary examination (Staatsexamen) which, in 1912, opened to him the gates to the arts departments of the University of his native city. Here he chose for the study of law under the guidance of such eminent scholars as A. A. H. Struycken, I. Henri Hijmans and above all Paul Scholten, the man who together with E. M. Meyers (of Leyden University) dominated Dutch legal science for a lifetime.

La Cour s'est réunie pendant 53 jours en 1961. Elle a commencé ses travaux le 4 avril, pour terminer sa session le 26 mai. Sous la présidence de S. Exe. M. Winiarski, la Cour a traité l'affaire du Temple de Préat Vihéar (Cambodge c. Thaïlande), Exceptions préliminaires, et elle a prononcé son arrêt le 26 mai.

Johannes Offerhaus est né à Assen, province de Drenthe, le 23 août 1892, d'une famille qui, depuis trois siècles déjà, a contribué à la vie intellectuelle aux Pays-Bas. Parmi ses ancêtres il y a des pasteurs, des magistrats, des professeurs d'université; son père a terminé une carrière dans la magistrature comme vice-président du Tribunal d'Arrondissement d'Amsterdam.

Op 21 September 1961 heeft de Broederschap der Notarissen in Nederland, te Utrecht haar jaarlijkse algemene vergadering ge-houden. Een belangrijk deel dezer vergadering werd gewijd aan de bespreking van een geschrift van de hand van de Amsterdamse notaris van der Ploeg, getiteld: Enkele Erfrechtelijke Hoofdstukken van Internationaal Privaatrecht, een geschrift dat de opsteller uitdruk-kelijk vermeden heeft een prae-advies te noemen, maar dat door de meeste debaters, alsook door de Voorzitter der Broederschap, in zijn slotwoord, als prae-advies werd gequalificeerd.

Tout juriste qui s'intéresse au droit international ou à la coopération internationale dans le domaine du droit, ne peut manquer de s'associer à l'hommage aujourd'hui rendu à MM. Kollewijn et Offerhaus.

Deze bijdrage toont in het geheel geen nieuwe feiten. Ik wil alleen pogen de geleding van de wereldlijke rechtsstof in de statensamenleving in beeld te brengen, tevens als verantwoording van standpunten en opvattingen. Een verantwoording, waartoe we gedrongen worden door de snelle, soms stormachtige veranderingen te midden van depressies en opklaringen in de volkenwereld. Vooral dringt daartoe de tegenstelling, die de huidige wereld verscherpt beheerst, in opvatting over recht en staat, niet in de laatste plaats over internationaal recht. Een goed deel van wat hier verder volgt, moet in onze diep gespleten wereld verworpen worden door hen, die de staat of het volk of een partij stellen boven het recht, of die het recht belichten met de lampen bv. van beweerde klassenoverheersing, of van het extreme nationalisme.

Dans son allocution de clôture de la Neuvième session de la Conférence de La Haye de droit international privé, M. Offerhaus a observé que les conflits de lois étaient passés quelque peu à l'arrière-plan dans les préoccupations de la Conférence. Une des marques les plus nettes de ce phénomène a été sans doute l'élaboration de la Convention sur «la compétence des autorités et la loi applicable en matière de protection des mineurs». Comme son titre l'indique, cette Convention a eu pour objet premier d'attribuer compétence en matière de protection des mineurs aux autorités du lieu de la résidence de l'enfant. La mention dans l'intitulé précité de la loi applicable ne doit pas faire illusion: les autorités déclarées compétentes appliqueront par principe leur propre loi, et si le texte adopté réserve un rôle à la loi personnelle, il est facile d'apercevoir qu'il y sera fait rarement appel: on a voulu au moins sur un terrain déterminé faire coïncider la compétence législative et la compétence judiciaire.
