Representing the International Committee of the Red Cross on this occasion gives me a welcome opportunity to thank the International Committee of Military Medicine and Pharmacy (ICMMP) for its constant help and support and at the same time to thank the many medical officers who offered their services to us for various medical missions in so many countries. The ICRC has always need of doctors and qualified medical personnel and we hope that these invaluable and essential volunteers will continue to come forward in sufficient numbers for the accomplishment of manifold, interesting, and satisfying humanitarian assignments.

Permettez-moi, au début de ce rapport, de dire combien je me sens honoré d'avoir été invité à participer aux travaux de votre savante association dont j'ai suivi avec intérêt depuis longtemps la très utile activité.

Vous avez bien voulu, pour ce Sixième Congrès, mettre parmi les sujets en dïscussion une question qui intéresse particulièrement l'institution à laquelle j'appartiens. Le Comité international de la Croix-Rouge, en effet, se préoccupait, depuis l'adoption des Conventions de Genève de 1949, d'établir, à l'intention des Autorités nationales intéressées, une loi-type qui pourrait servir de modéle et d'inspiration pour les différentes mesures d'application qui doivent être prises.

The protection of refugees and displaced persons is guaranteed by many universal and regional instruments of international law. The rules are there, but for several years the humanitarian organizations charged with implementing them have constantly had to face new situations brought about by the scale and frequency of mass population movements, especially in the Third World, and new types of violence which affect both the status and the possibilities for protection of the people concerned. Very often, the solutions arrived at by these bodies have taken the form of assistance rather than protection, the one not always easily distinguishable from the other.

The Diplomatic Conference on the Reaffirmation and Development of International Humanitarian Law Applicable in Armed Conflicts met in Geneva from 1974 to 1977. During its fourth session, in 1977, the Conference finally adopted two Protocols additional to the Geneva Conventions of 12 August 1949 for the protection of victims of war—Protocol I relating to international armed conflicts and Protocol II relating to non-international conflicts.

El Movimiento Intemacional de la Cruz Roja y de la Media Luna Roja desea aprovechar esta oportunidad para rendir homenaje a todos los que sirven a su causa humanitaria, y cuya generosa entrega permite no sólo prestar asistencia médica y ayuda a millones de personas que lo necesitan, sino también llevar un mensaje de esperanza a un mundo asolado por los desastres, la guerra y los sufrimientos.

Con el final de la guerra fría pensamos que las perspectivas de futuro serían más alentadoras. Sin embargo, los padecimientos de la población no han disminuido. Por el contrario, en muchas partes del mundo estos sufrimientos se han agudizado. El estallido de conflictos armados, la violencia étnica y las catástrofes naturales representan una amenaza constante para la vida y la dignidad de millones de hombres, mujeres y niños. Algunas enfermedades, como el SIDA y el paludismo, así como la pobreza y la malnutritión, también afectan a innumerables personas en el mundo.

The international community has been struggling to reach agreement on the non-proliferation and elimination of nuclear weapons since they were first used in 1945. Encouragingly, recent global debate has, for the first time, focused on the devastating humanitarian consequences that the use of nuclear weapons will have not only for nuclear weapons States but for all humanity. The fact that the risks and overwhelming humanitarian consequences of a nuclear event are so high, combined with the inability of the global community to adequately respond to the needs of victims, has compelled policy-makers to consider new ways to work towards the prohibition of the use of nuclear weapons under international law. This article examines how the “humanitarian initiative” has reframed the nuclear weapons debate away from the traditional realm of State security, deterrence and military utility, and towards the grim reality of the humanitarian impacts that would confront humankind if nuclear weapons were ever used again.

Armed conflicts leave populations vulnerable to organ trafficking, a criminal enterprise with little international regulation when viewed separately from human trafficking. The Council of Europe's Convention against Trafficking in Human Organs is the only instrument to contemplate the responsibility of actors involved in organ trafficking, but traffickers may go unpunished due to its limited scope. Yet in armed conflict, international humanitarian law offers additional protection. The rules protecting the living and the dead against ill-treatment provide the basic level of protection necessary to consider the international responsibility of organ trafficking networks and the individual criminal responsibility of their members.

La société de l'information qu'on nous promettait hier est en train d'advenir. Et dans cette société du tout-médiatique, les bouleversements entraînés par l'essor des technologies de l'image, toutes catégories confondues, obligent l'ensemble de ce qu'on appelait jadis «la presse» à se redéfinir, à réinventer sa déontologie et ses méthodes de travail. Ce n'est qu'en replaçant l'image dans le mouvement global de l'information, et notamment dans son rapport avec l'écrit, qu'on peut en mesurer l'enjeu. Notre vision du monde est de plus en plus façonnée par les images télévisuelles et photographiques qui dominent l'espace public. Si grande est l'influence de l'image que Ton peut affirmer, avec de nombreux analystes, qu'elle est en passe de remplacer la réalité: n'existe aujourd'hui que ce qui est authentifié, certifié, valorisé par la caméra et l'écran de télévision. Dans la ronde des images, tout ce qui n'est pas filmé, photographié, diffusé est par conséquent aussitôt anéanti, réduit à l'inexistence sociale. Mais quel est done le secret de la force irrésistible des images?

Visitador de prisiones, abogado de los internados enemigos en los países beligerantes, médico o cirujano al lado de los heridos y de los enfermos víctimas de las hostilidades, notario del cautiverio para identificar a los detenidos, buscar a los desaparecidos, reagrupar a familiares, distribuir víveres y mantas, organizar traslados y transportes, el delegado del Comité Internacional de la Cruz Roja hace todo eso y mucho más.

Es, en primer lugar, un hombre de buena voluntad que, puede considerarse, acude en ayuda de las autoridades detentoras para resolver los delicados problemas planteados por el fenómeno grave del cautiverio de guerra. Generalmente, su labor no resulta fácil; su acción se lleva a cabo en un país que precisamente la guerra ha convulsionado y desorganizado. Se ocupará de enemigos de tal país, de prisioneros e internados que, muy a menudo, son objeto de odio.
