Armed conflicts leave populations vulnerable to organ trafficking, a criminal enterprise with little international regulation when viewed separately from human trafficking. The Council of Europe's Convention against Trafficking in Human Organs is the only instrument to contemplate the responsibility of actors involved in organ trafficking, but traffickers may go unpunished due to its limited scope. Yet in armed conflict, international humanitarian law offers additional protection. The rules protecting the living and the dead against ill-treatment provide the basic level of protection necessary to consider the international responsibility of organ trafficking networks and the individual criminal responsibility of their members.

La comunidad internacional se ha percatado recientemente de los efectos negativos que pueden tener, en los países afectados por crisis, algunas acciones de urgencia en las fases posteriores a la reanudación del desarrollo. Por ello, se ha puesto de moda el concepto de continuidad «urgencia-desarrollo». Se trata de conciliar las acciones que deben organizarse durante la fase de crisis aguda con las de etapas ulteriores.

Visitador de prisiones, abogado de los internados enemigos en los países beligerantes, médico o cirujano al lado de los heridos y de los enfermos víctimas de las hostilidades, notario del cautiverio para identificar a los detenidos, buscar a los desaparecidos, reagrupar a familiares, distribuir víveres y mantas, organizar traslados y transportes, el delegado del Comité Internacional de la Cruz Roja hace todo eso y mucho más.

Es, en primer lugar, un hombre de buena voluntad que, puede considerarse, acude en ayuda de las autoridades detentoras para resolver los delicados problemas planteados por el fenómeno grave del cautiverio de guerra. Generalmente, su labor no resulta fácil; su acción se lleva a cabo en un país que precisamente la guerra ha convulsionado y desorganizado. Se ocupará de enemigos de tal país, de prisioneros e internados que, muy a menudo, son objeto de odio.

Si grande est l'influence de l'image que Ton peut affirmer, avec de nombreux analystes, qu'elle est en passe de remplacer la réalité: n'existe aujourd'hui que ce qui est authentifié, certifié, valorisé par la caméra et l'écran de télévision. Dans la ronde des images, tout ce qui n'est pas filmé, photographié, diffusé est par conséquent aussitôt anéanti, réduit à l'inexistence sociale. Mais quel est done le secret de la force irrésistible des images?

At the outbreak of the Second World War, international humanitarian law was made up of the various Hague Conventions of 1907 and the two 1929 Geneva Conventions, none of which dealt in a satisfactory manner with the risks faced by the civilian population. Experience during the war made a major revision of international humanitarian law a priority after 1945. This articles traces the history of that endeavour up to the adoption by a diplomatic conference, on 12 August 1949, of the four Geneva Conventions for the protection of war victims. Particular emphasis is laid on the link between the ICRC's wartime experience with the inadequate law of the day and the negotiations for new legal provisions. The second part of the article identifies the major advances represented by the 1949 Geneva Conventions, one of the more important being the fact that the law's scope was extended to non-international armed conflicts. Though making no claim to perfection, the new Geneva Conventions nevertheless laid a sound basis on which adequate solutions may be found when military considerations and humanitarian exigencies clash.

Cet article se propose d'examiner les mandats qui sont exercés en matière de protection et d'assistance aux réfugiés dans les cas de conflits armés et de troubles intérieurs. Il essaie modestement d'établir des distinctions dans les rôles et les mandats des organes humanitaires, qui souvent se ressemblent et se recoupent, en particulier pour le Mouvement international de la Croix-Rouge et du Croissant-Rouge (le Mouvement) et le Haut Commissariat des Nations Unies pour les réfugiés (HCR). Il voudrait également redéfinir l'évolution de leur mandat et en déterminer l'extension. Les principes de l'action humanitaire, fondés sur la pratique passée et présente, ont certes besoin d'être clairement définis, mais il faut laisser jouer la souplesse et le pragmatisme là où n'existe aucun pronostic d'ensemble. La conclusion montrera l'intrdépendance et la complémentarité des organisations humanitaires qui ont à apporter protection et assistance dans les situations où aucun autre organe n'est en mesure d'agir.

The International Criminal Tribunal for Rwanda was created on 8 November 1994 by the United Nations Security Council, of which it is a subsidiary body. Its task is to help restore and maintain peace and bring about national reconciliation by trying persons allegedly responsible for acts of genocide and other grave breaches of international humanitarian law committed in Rwanda and Rwandan citizens suspected of committing such acts and violations in the territory of neighbouring States between 1 January and 31 December 1994.

Will the Red Cross survive? Should it survive? Has it really a mission in the world of today? In the world of the 1980s and thereafter? What is that mission? How can Red Cross gear up for it?

These questions have been the subject of thoughtful discussion among Red Cross people for some years. In 1972, the International Committee of the Red Cross and the League of Red Cross Societies, in co-operation with the National Societies, decided to take a hard look at the future in the form of a comprehensive examination of the role of the Red Cross.

The work of the Red Cross is born of a high ideal, from which it continually draws fresh life, but as it primarily consists of practical actions, frequently improvised, there is a serious risk that in the haste of charitable action and in spite of the purity of one's intentions, one may deviate from the guiding principles and unity of thought may diminish, the more so as the institution takes root in every corner of the world. It is therefore particularly necessary that the Red Cross possesses a well-defined and firmly established doctrine.
