This article considers the question ‘How should institutions enable people to meet their needs in situations where there is no guarantee that all needs can be met?’ After considering and rejecting several simple principles for meeting needs, it suggests a new effectiveness principle that (1) gives greater weight to the needs of the less well off and (2) gives weight to enabling a greater number of people to meet their needs. The effectiveness principle has some advantage over the main competitors including a principle suggested by David Miller in Principles of Social Justice. Miller argues that his principle accounts for the existing data on individuals' intuitions about meeting needs. The effectiveness principle better accounts for this data. Furthermore, this article presents a new experiment on intuitions about meeting need that is consistent with the effectiveness principle but not Miller's principle.

I begin by reconsidering the arguments of John Taurek and Elizabeth Anscombe on whether the number of people we can help counts morally. I then consider arguments that numbers should count given by F. M. Kamm and Thomas Scanlon, and criticism of them by Michael Otsuka. I examine how different conceptions of the moral method known as pairwise comparison are at work in these different arguments and what the ideas of balancing and tie-breaking signify for decision-making in various types of cases. I conclude by considering how another moral method that I call virtual divisibility functions and what it helps reveal about an argument by Otsuka against those who do not think numbers count.

The distinction between killing and letting die is too simple. A third category – preventing people from being saved – must also be recognized. Like killing, preventing a person from being saved is a species of doing harm; like killing, it infringes one of the victim's negative rights. Yet preventing a person from being saved is morally on a par with letting die, which infringes one of the victim's positive rights. It follows that we cannot explain the moral inequivalence of killing and letting die by saying, as so many have, that negative rights are more stringent than positive rights. A more promising strategy is suggested at the end of the article.

Jeremy Bentham's ‘Nonsense upon Stilts’, hitherto known as ‘Anarchical Fallacies’, has recently appeared in definitive form in The Collected Works of Jeremy Bentham. The essay contains what is arguably the most influential critique of natural rights, and by extension human rights, ever written. Bentham's fundamental argument was that natural rights lacked any ontological basis, except to the extent that they reflected the personal desires of those propagating them. Moreover, by purporting to have a basis in nature, the language of natural rights gave a veneer of respectability to what, in the case of the French Revolutionaries at least, were at bottom violent and selfish passions. Yet that having been said, Bentham had no objection to the notion of a right which expressed a moral claim founded on the principle of utility. However, the phrase ‘securities against misrule’ better captured what was at stake, and avoided all the ambiguities otherwise associated with the word ‘right’.

Bentham was once thought to be the father of the principle which he called ‘the greatest happiness principle’. Now Hutcheson with his ‘greatest happiness for the greatest numbers’ is the generally accepted source of this test of moral behaviour. It is not in Britain, however, but in Germany that one finds its origin. A quarter of a century before Hutcheson's An Inquiry into the Origin of our Ideas of Beauty and Virtue (1725), a German philosopher provided a formulation of the principle on which Hutcheson relied.

You face two buttons. Pushing one will destroy Greensboro. Pushing the other will save it. (Sorry, doing nothing also destroys Greenboro.) There is no way for you to know which button saves and which destroys. What ought you to do? Answer: You ought to make the correct guess and push the button that saves Greensboro. Second question: Do you have an obligation to push the correct button?

Women tend to earn less than their male colleagues. Furthermore, women tend to earn less than men who hold jobs that are nominally different but relevantly similar to their own. Advocates of ‘comparable worth’ protest these facts. Their protest sometimes takes this form: Those differences in pay between men and women are undeserved. The argument for this claim is simple. Some facts are relevant to the wage one deserves for performing a given job; some are not. In the vast majority of cases, the argument continues, gender is not relevant to the wage one deserves; relevant are, say, the skill, responsibility, and working conditions required by the job. When jobs are comparable with respect to these facts, those who work in them deserve equal pay. Therefore, women and men who work the very same jobs deserve equal pay; likewise for women and men whose jobs are nominally different but relevantly similar.

My question, which is central to the business of moral philosophy, is implicitly addressed by many philosophers, yet explicitly addressed by only a few. In this paper I address the question head-on, and propose a qualified affirmative answer.

First, however, it is important to be clear about what is meant by ‘morality’ and ‘progress’, and what the meaning of ‘is’ is. My characterizations will not be exact, but I hope they will be precise enough to specify a domain that can be productively investigated.

In comparing Sen's work with Mill's, Sugden criticizes Sen's capability approach because it may be applied in such a way that society or theorists judge what is best for people and potentially restrict liberty on that basis. Sugden cites Nussbaum's work as evidence in making his case. Sugden's critique of Sen's approach succeeds on a narrow reading of it. On that reading Sen is also critical of it because it does not leave enough room for liberty. On a broad reading, the critique has less force. Nussbaum's approach follows Mill in allowing people freedom to act on whatever desires they have if this does not harm others. This neutralizes the central element of Sugden's critique as it applies to her approach to some degree. Both Sen and Nussbaum nonetheless recognize the danger of illiberal restrictions in application which motivates Sugden's critique.

Drawing on the author's recent book Ethics for a Broken World, this article explores the philosophical implications of the fact that climate change – or something like it – might lead to a broken world where resources are insufficient to meet everyone's basic needs, and where our affluent way of life is no longer an option. It argues that the broken world has an impact, not only on applied ethics, but also on moral theory. It then explores that impact. The article first argues that the broken world creates severe difficulties for both libertarians and contractualists. It then explores the impact of the broken world on utilitarianism – and especially on reflective equilibrium arguments for rule-utilitarianism. The article concludes that, while such arguments may still be viable, the form of rule-utilitarianism that results will be less moderate and less liberal than contemporary rule-utilitarians might hope.

In On Liberty, Mill introduced the concept of ‘experiments in living’. I will provide an account of what Mill saw to be the basic problem he was addressing – the extensive pressure to fit in with the crowd, and how this bred mediocrity. I connect this to worries about public reason models of justification. I argue that a generalized version of Mill's argument offers us a better path to political justification stemming from experimentation. Rather than grounding political justification on shared political reasons, we justify our political culture on our ability to reject consensus views and try alternatives.

John Broome argues that when all claims cannot be perfectly fairly satisfied in outcome, the contribution to fairness from entering claims into a lottery, and so providing them some surrogate satisfaction, ought to be weighed against, and can outweigh, what fairness can be achieved directly in outcome. I argue that this is a mistake. Instead, I suggest that any contribution to fairness from entering claims into a lottery is lexically posterior to fairness in outcome.

Prioritarianism is supposed to be a theory of the overall good that captures the common intuition of ‘priority to the worse off’. But it is difficult to give precise content to the prioritarian claim. Over the past few decades, prioritarians have increasingly responded to this ‘content problem’ by formulating prioritarianism not in terms of an alleged primitive notion of quantity of well-being, but instead in terms of von Neumann–Morgenstern utility. The resulting two forms of prioritarianism (respectively, ‘Primitivist’ and ‘Technical’ prioritarianism) are not mere variants on a theme, but are entirely distinct theories, amenable to different motivating arguments and open to different objections. This article argues that the basic intuition of ‘priority to the worse off’ provides no support for Technical Prioritarianism: qua attempt to capture that intuition, the turn to von Neumann–Morgenstern utility is a retrograde step.

The law concerning punishment is a Categorical Imperative; and woe to him who rummages around in the winding paths of a theory of happiness, looking for some advantage to be gained by releasing the criminal from punishment or by reducing the amount of it (Rl. A196/B226, 6:331; Ladd, 100).

Is the relation ‘is a morally permissible alternative to’ transitive? The answer seems to be a straightforward yes. If Act B is a morally permissible alternative to Act A and Act C is a morally permissible alternative to B then how could C fail to be a morally permissible alternative to A? However, there are cases where this transitivity appears problematic. My aim in this article is to provide a solution to this problem. I will then investigate two ways in which we might justify rejecting the transitivity of the ‘is a permissible alternative to’ relation. Next, I will look at Dorsey's solution, which involves a reinterpretation of the intuitions used to generate the problem. I will argue that none of these solutions are fully satisfying, before going on to provide a novel solution to the problem and to argue that it avoids the problems facing the alternative solutions.

Perhaps the best-known theory of fairness is John Broome's: that fairness is the proportional satisfaction of claims. In this article, I question whether claims are the appropriate focus for a theory of fairness, at least as Broome understands them in his current theory. If fairness is the proportionate satisfaction of claims, I argue, then the following would be true: fairness could not help determine the correct distribution of claims; fairness could not be used to evaluate the distribution of claims; fairness could not guide us in distributing claims (or unowed goods); we could not have a claim to be treated fairly; and we would not be wronged when treated unfairly. These entailments mean that it is questionable that fairness is concerned with claims in the way Broome suggests. At the very least, the relationship between fairness and claims appears to be more complex than the picture painted by Broome.

This article seeks to defend prioritarianism against a pair of challenges from Michael Otsuka and Alex Voorhoeve. Otsuka and Voorhoeve first argue that prioritarianism makes implausible recommendations in one-person cases under conditions of risk, as it fails to allow that it is reasonable to act to maximize expected utility, rather than expected weighted benefits, in such cases. I show that, in response, prioritarians can either reject Otsuka and Voorhoeve's claim, by means of appealing to a distinction between personal and impersonal value, or alternatively they can harmlessly accommodate it, by means of appealing to the status of prioritarianism as a view about the moral value of outcomes, rather than as an account of all-things-considered reasonable action. Otsuka and Voorhoeve secondly claim that prioritarianism fails to explain a divergence in our considered moral judgement between one-person and many-person cases. I show that the prioritarian has two alternative, and independently plausible, lines of response to this charge, one more concessive and the other more unyielding. Hence, neither of Otsuka and Voorhoeve's challenges need seriously trouble the prioritarian.

Hume considered An Enquiry Concerning the Principles of Morals (1751) incomparably the best of all his writings. In the argument advanced here, I propose that Hume's preference for the Enquiry may be linked to his admiration of Cicero, and his work, De Officiis. Cicero's attempt to discover the honestum of morality in De Officiis had a particular relevance and appeal for philosophers of the early eighteenth century who were seeking to establish what they called the foundation of morality. One of those philosophers was Francis Hutcheson; his differences with his contemporaries and with Hume are reviewed in the second and third parts of the essay. In the fourth and final section, I examine Hume's attempt to reconcile the foundation of morality, as he under-stood it, the sentiment of humanity, with the principles of utility and agreeableness. And an attempt is made, finally, to explain why Hume's critics (James Balfour, Thomas Reid) perceived Hume's Enquiry to be the work of an Epicurean and a sceptic.

T. M. Scanlon has revived a venerable tradition according to which something's being good consists in its being such that there is a reason to respond positively towards it. He has presented novel arguments for this thesis. In this article, I first develop some refinements of the thesis with a view to focusing on intrinsic value in particular, then discuss the relation between the thesis and consequentialism, then critically examine Scanlon's arguments for the thesis, and finally turn to the question whether we should reject the thesis on the grounds that, when there is a reason to respond positively towards something, this is so because the thing in question is good. Two appendices follow. In the first, I discuss whether it is good to do right. In the second, I discuss whether an act's being wrong provides a reason not to do it.

It seems common at the moment to make agent-neutrality a necessary condition of ‘consequentialism” and to hold that deontological ethics are agent-relative. This note argues that both these tendencies regrettably obscure useful terms and distinctions. It concludes by considering what it would be best, now, to mean by ‘utilitarianism” and making a proposal.
