Applied ethics is at a watershed. In all its domains a gulf between the theory of applied ethics and the practice of applied ethics is now being recognized. In medical ethics, for example, it has been observed that “practicing clinicians often feel let down by bioethics.” The disappointment of clinicians is attributed in part to their own unrealistic expectations but is also said to be a function of

the extent to which bioethics as a discipline doesn't seem to be in possession of the realities of practice. Bioethicists tend to leave the “facts” of clinical medicine to the doctors; their task is then to apply elegant and compelling arguments drawn from first principles of ethics … to these undisputed and indisputable facts. Unfortunately, when the relationship between clinical medicine and bioethics is conceived … [in this way], the result is a very sterile discourse.

Increasingly our society relies upon government regulatory agencies to protect its people, its institutions and its environment from the negative impacts of new technologies. These agencies are saddled with the task of deciding among strongly conflicting viewpoints represented by a wide range of interest groups and “value communities” within the society. When regulatory decisions are made some interests and values are protected while others are curtailed.

Qu'il y ait une détérioration de l'environnement présentant des risques pour le bien-être et même pour la survie de l'humanité tout entière est actuellement hors de doute. Que cette détérioration soit due à une pratique, qui suppose un anthropocentrisme et une conception instrumentaliste de la nature, est incontestable. Pour résoudre donc le problème environnemental, ne serait-il pas nécessaire aux hommes qu'ils changent leur pratique et qu'ils établissent des relations d'un nouveau genre avec la nature? Ne devraient-ils pas adopter de nouveaux comportements à son égard, se donner une nouvelle éthique de l'environnement? Pour certains environnementalistes, c'est dans cette direction que les hommes devraient s'engager; ils croient fermement que les risques d'une catastrophe écologique ne peuvent être enrayés que par une conversion des hommes à de nouvelles valeurs et à une nouvelle perception de leur situation dans le monde. Le problème qui s'impose est de construire une nouvelle éthique de l'environnement; la pertinence de cette construction n'est plus à démontrer.

En 1972, le Southern California Law Review publiait un article de C. D. Stone dans lequel ce dernier avançait l'idée particulièrement avant-gardiste d'une attribution de droits légaux à des objets naturels (forêts, océans et autres objets naturels que Stone laisse relativement indéterminés). Plus récemment, en France, M.-A. Hermitte procédait à son tour à une «réflexion de technique législative» (1988, p. 241) où elle suggérait de faire de la nature — plus précisément de zones biologiques — un sujet de droit. De telles propositions n'ont pas manqué de susciter la controverse tant dans les milieux juridiques que philosophiques. N'est-il pas en effet généralement reconnu que seul l'être humain possède les attributs permettant d'être un sujet de droit? Étendre ce privilège à d'autres entités ne risque-t-il pas, par le jeu des rapports conflictuels susceptibles de se produire entre titulaires de natures différentes, d'affaiblir la protection déjà parfois insuffisante accordée aux droits des humains? Lors d'un conflit entre le droit d'un milieu naturel et celui d'un individu, lequel de ces titulaires de droits — et en fonction de quels critères — faudra-t-il en effet privilégier? L'environnement ou l'être humain?

Depuis les années 70, sous l'influence notamment des travaux du Hastings Center, l'éthique de l'ingénierie a connu un développement remarquable. De la déontologie des ingénieurs, historiquement liée à la pratique du génie conseil, elle s'est progressivement ouverte aux autres décideurs en ingénierie, en particulier au «monde des affaires». Elle est devenue, d'autre part, un champ de réflexion multidisciplinaire tenant compte des impacts sociaux et environnementaux du développement technologique ainsi que du contexte industriel dans lequel évolue la majorité des ingénieurs. Tenant compte enfin des risques inhérents à la société technicienne, l'éthique de l'ingénierie a porté une attention particulière à la pratique du consentement éclairé du public dans le développement industriel et technologique. Créneau spécifique de la recherche actuelle en éthique professionnelle, l'éthique de l'ingénierie n'annule toutefois pas la tradition déontologique des corporations et des sociétés d'ingénieurs. Elle en constitue plutôt le contexte critique, sollicitant une évolution et une adaptation de la pratique, et conséquemment de la déontologie tant théorique que pratique de la profession.

La transformation des pratiques professionnelles au cours des dernières décennies a fait l'objet d'études sociologiques relativement nombreuses. Pour rendre compte de cette transformation en cours, on y analyse le jeu interactif de facteurs d'ordres divers: le développement scientifique et technologique, qui aurait modifié de façon radicale les pratiques professionnelles et leur statut propre en les faisant passer de l'art à la technoscience; le souci croissant, dans les sociétés démocratiques néo-libérales, du respect de l'autonomie des personnes, et l'appel corrélatif à la prise en charge d'elles-mêmes par les personnes et par les collectivitées; l'institutionnalisation des pratiques professionnelles, comme plus largement de toutes les pratiques de travail, et leur soumission conséquente aux exigences des rationalités économique (et proprement budgétaire et comptable) et administrative (et souvent bureaucratique); l'interdépendance de facto des diverses pratiques professionnelles, interdépendance désormais requise en vue de la prise en compte de la complexité des interactions dans la dynamique de réalités et de situations toujours mouvantes; les réclamations d'un contrôle démocratique plus rigoureux tant des interventions professionnelles elles-mêmes et de leurs orientations que de leur instrumentation.

In the last several years, ethicists have discussed problems of medical, professional, business and environmental ethics with much animation, and political philosophers have shown more interest than before in details of public policy. Yet this “applied turn,” as it has been called, has not swept much philosophical attention in the direction of taxation and public finance, though they offer numerous conceptual challenges. Nor have these subjects engaged the attention of those in the critical thinking business, though distortions in representing them are common enough.

There is overwhelming consensus today that passively allowing someone to die in medical contexts is sometimes morally permissible and desirable. Active euthanasia, however, remains controversial. The legal systems and the medical establishments of both the United States and Canada maintain absolute, formal prohibitions against direct killing in medical settings. This clearly reflects the deep-seated belief, evident throughout our cultural and religious history, that there is some important moral difference between killing and allowing to die. Yet much that has been written recently on this topic by philosophers has denied moral relevance for this distinction. While this general conclusion appears to have gained popularity, especially within philosophy, the reasons advanced for it seem inconclusive to some. In what follows I examine the principal philosophical argument for the claim of irrelevance. I then develop an alternative view that, to my knowledge, has not been distinctly articulated in the current literature. I begin, however, with a preliminary discussion of the intuitive basis of the distinction between killing and letting die.

Abortion has long been a central issue in the arena of applied ethics, but, the distinctive analysis of feminist ethics is generally overlooked in most philosophic discussions. Authors and readers commonly presume a familiarity with the feminist position and equate it with liberal defences of women's right to choose abortion, but, in fact, feminist ethics yields a different analysis of the moral questions surrounding abortion than that usually offered by the more familiar liberal defenders of abortion rights. Most feminists can agree with some of the conclusions that arise from certain non-feminist arguments on abortion, but they often disagree about the way the issues are formulated and the sorts of reasons that are invoked in the mainstream literature.

Les prélèvements et les transplantations de tissus et d'organes renvoient à des problèmes très variés au plan éthique en raison des types d'organes ou de tissus prélevés et transplantés, du statut du donneur et enfin de la finalité du prélèvement. Soyons plus précis: aujourd'hui, on prélève en vue d'une transplantation: les reins, le cœur, les poumons, le foie, le pancréas, la cornée mais aussi, la moelle osseuse, la peau. On prélève à diverses fins — thérapeutique ou de recherche — : le sang, la rate, les cellules embryonnaires, les gamètes. Le donneur quant à lui, suivant les organes prélevés, sera: vivant ou mort, adulte, enfant, nouveau-né anencéphale ou embryon.

Après avoir, en préambule, défini l'expérimentation humaine au sens qui est ici visé, j'identifierai le don qu'elle implique au sein d'une chaîne de solidarité, puis j'analyserai quelques difficultés auxquelles donne lieu l'intégration culturelle de cette démarche de partage, enfin je mettrai en évidence un conflit entre solidarité et autonomie.

Je crois utile de préciser d'emblée que le champ concret que j'ai eu à l'esprit en rédigeant ce texte est d'abord celui du prélèvement et de la transplantation d'organes et de tissus, moins systématiquement celui de la disposition de produits du corps (sang, gamètes, voire embryons), de façon plus lointaine enfin celui de l'expérimentation humaine. Dans les deux premières problématiques surtout, «certaines choses» dont le statut est très spécial s'échangent entre des personnes.

What would be a genuinely caring approach to the provision of procedures of so-called artificial reproduction such as in vitro fertilization (IVF)? What are appropriate and justified social policies with respect to attempting to enable infertile persons to have offspring? These urgent questions have provoked significant disagreements among theologians, sociologists, healthcare providers, philosophers and even — or especially — among feminists. In the existing literature and in developing social policy, three different kinds of answers can be discerned. (1) Some have suggested that access to IVF should be provided as a matter of right. (2) Some existing social policies and practices imply that access to IVF is a privilege. (3) Some theorists have argued that, because of its alleged violation of family values and marital security, or because of its risks, costs, and low success rate, IVF should not be available at all. After evaluating each of these views, I shall offer a feminist alternative, describing what I think would constitute the caring provision of in vitro fertilization.

For a variety of reasons, the AIDS epidemic is forcing a thorough reassessment of many of the standards by which the terminally ill and other medical patients are treated by health-care systems throughout the world. This has generally been a good thing. It has provided needed motivation for public policy-makers to take seriously a range of health-care issues that have often been downplayed, ignored, or debated with vigour only within the relatively mute pages of the academic journals of health-care professionals, philosophers, law professors and others. Issues such as euthanasia, testing for dangerous communicable diseases, palliative care, and even important general questions about the distribution and availability of health-care resources have been pushed toward the front of the public health-care agenda largely because of the impact of AIDS. And it is fair to say that these matters are often being addressed with an urgency and sensitivity that would be absent without the political impetus that was unleashed along with this disease. One of the most controversial issues that has arisen concerns access to experimental therapies by the terminally ill. As is the case in other areas, the political forces generated by the AIDS tragedy have created an opportunity for productive review of policies and practices that undoubtedly deserve scrutiny and reform. However, my aim in this paper is to urge caution on some of the advocates of reform. I will argue that many recent proposals to enhance access to experimental therapies by the terminally ill rest on philosophically unsupportable grounds and pose an unjustifiable threat to the public interest in finding safe and effective therapies for terminal illnesses.

Il est done naturel que les milieux médicaux et hospitaliers soient générateurs de normes d'une part et, d'autre part, utilisent celles-ci de façon courante dans les relations humaines.

In selecting for discussion the general theme of the donation and sharing of cells, tissues and organs (typically accomplished by transfusion and other forms of surgical transplantation) the program committee of the Second Congress of the Canadian Bioethics Society appears to have been astonishingly prescient in anticipating that two North American physicians —clinical researchers rather than “basic” scientists, by the way —would receive, as they did just over a month ago, Nobel Prizes in Physiology or Medicine for their medical achievements.1 Dr. Joseph Murray was cited in part for successfully performing, in 1954, the first human kidney transplant (the recipient lived eight years), as well as for discovering how to minimize the body's rejection of this organ; Dr. Donnall Thomas was cited for work he accomplished in 1956 —the first bone-marrow cell transfusion to a 16-year-old patient (who is still alive) such that the human immune reaction of a graft to this recipient's body could be medically managed to avoid rejection of the transplanted material (Economist 1990). Having mentioned these awards, I should note that Dr. George Hitchings had already received the Nobel Prize in Medicine in 1988, being credited with the discovery of a powerful immunosuppressant, azathioprine, which greatly improved the survival of the recipients of unmatched graft transplants.
