Au cours du Moyen-Age tardif et de la période moderne, le transfert et la redistribution des terres qui se faisaient auparavant hors marché sont devenus objets de transactions sur marché. Mais cela n'a été en rien un processus général et unilinéaire. Au contraire on observe de fortes différences selon les régions et des discontinuités dans le temps. Nous entendons ici mieux comprendre les facteurs qui furent à l'origine de ces différences en reconstruisant et en analysant les institutions organisant les échanges de terres et de baux. Cette analyse, qui couvre l'Europe du Nord-Ouest et l'Italie, nous indique que le contexte socio-politique a joué un rôle déterminant dans cette organisation.

This article discusses family patterns in the vast territories of historical Poland and Lithuania at the end of the eighteenth century. It explores one of the largest collections of historical household data in Europe on pre-industrial rural settings, and applies a variety of methodologies to reveal various aspects of family systems, as well as their spatial distribution. Three regional family patterns have been distinguished in the historical Polish territories, differing both in terms of household structure and household formation rules and in terms of their marriage patterns. Analysis of the dataset on these spatially, culturally and socioeconomically diverse regions has also facilitated the preliminary identification of the factors shaping these family systems. Contrary to conventional wisdom, the data presented here suggest that the impact of second serfdom on family structure was by no means uniform, and that factors other than purely economic ones may actually have accounted for the diversity of family systems prevailing in historical Poland and Lithuania.

This article illustrates various characteristics of the real-estate market in Lumezzane, a village in the Lombard Prealps between the eighteenth and the nineteenth centuries. It reveals the types of property sold, the objectives of the buyers and sellers, the prices paid and, in some cases, the credit arrangements undertaken. The research indicates the relationship between the credit market and the type of manufacture in the region. Particular institutions, most notably religious foundations known as the Luoghi Pii, as well as private individuals, provided capital to artisans in the absence of banks. This availability of credit at favourable rates allowed artisans to produce manufactured goods at a competitive price even in difficult economic times. The importance of industry in the region both influenced strategies of inheritance and limited the need for the type of out-migration that characterized most Alpine regions during the period.

This article examines spousal cooperation in the early modern Dutch food markets. It shows that although husband and wife business partnerships were very common in market-based retailing, great differences existed in the way spouses worked together. Most urban retail trades were guild-organized and the guilds therefore had a significant influence on the family economy. Guild policy was, however, very flexible and responded to local economic circumstances. It appears that the size and the organization of the markets were crucial in shaping the roles of the men and women who held stalls. Processes of commercialization generally benefited independent female entrepreneurship over the more traditional husband and wife partnerships.

In the course of the late Middle Ages and early modern period, in Western Europe, ways of transferring and redistributing land outside the market were replaced by market transactions. This, however, was by no means a general and unilinear process, but one that displays strong regional differences and temporal discontinuities. This article aims to gain more insight in the factors underlying these differences, by reconstructing and analysing the institutional organization of exchange in land and lease markets. The analysis, undertaken for northwestern Europe and Italy, points to the socio-political context as a main determinant of this organization.

Recent research on the development of peasant land markets and transfer patterns for central and east-central Europe concentrated on the early modern period. For the late Middle Ages, rural history still relies on older approaches studying the general development of ‘agrarian structure’ (Agrarverfassung) and peasant ‘inheritance’. This article seeks to establish the basis for a more systematic analysis of the formation and general development of peasant land markets in late medieval central and east-central Europe in a comparative perspective. Apart from changes weakening traditional manorial structures, secure peasant property rights of hereditary tenure developed and prevailed by the later Middle Ages. Possible institutional rigidities of transactions with peasant farmland, whose effects in practice would need further exploration, were undermined by the existence of reserves of land situated outside the measured open fields of peasant farms that could be traded more flexibly. These areas also formed important resources for the establishment of smallholders and cottagers who in turn added to the dynamics of developing peasant land markets. In the final section, the article offers a brief survey of developments during the early modern period and concludes that traditional images of an undermining of peasant property rights and of massive landlord powers due to the rise of ‘demesne lordship’ (Gutsherrschaft) must be seriously questioned, as recent empirical studies highlight enormous regional variation and a dominant pattern of continuity of secure peasant property rights and also indicate considerable land mobility.

This article summarizes aspects of the decline in infant mortality in the five Nordic countries. During the nineteenth century, both the levels of infant mortality and its development differed among the Nordic countries. At an early date, Denmark, Norway and Sweden stood out as the countries with the lowest levels in Europe whereas levels of infant mortality in Iceland and Finland were comparatively high. Within the countries there were large regional differences that often crossed national borders. Artificial feeding characterized most of the areas with the highest infant mortality. Within the different countries the high infant mortality came to be seen as a problem during the eighteenth and nineteenth centuries. The spread of information, midwives as agents of change and high literacy are factors that have been proven important in explaining the subsequent decline.

This article aims to provide an empirical test of Jan de Vries' theory of the ‘industrious revolution’, most notably his assumptions concerning the increased participation of married women in the labour force. The focus is on the pre-industrial textile industry in the Dutch Republic, within which a distinction is made between various ways in which family members cooperated in the work they undertook. This differentiation depended on the existing segmentation of the labour market, between social groups and between the sexes. It is shown that at least some groups within proletarian textile families were able to make a decent living, and that the earnings of wives played an important role in the increased industriousness of these families.

The evidence of criminal court records suggests that almost all London wives were engaged in gainful occupations in the eighteenth century. The records of the City livery companies and of Christ's Hospital show that the wives of craft masters and professional men worked, as well as those in poorer families where their income was essential. At lower socio-economic levels it was unusual for couples to work in the same trade. At middling levels it was more common, especially in textiles and retail, but no more than half of couples worked together or in related occupations.

In the second half of the nineteenth century in the remote farming district of Dungog in the colony of New South Wales on the Australian continent, widows faced harsh economic realities. Using civil registration records, census data, newspaper reports, statistical returns, family histories and other sources, we have, where possible, reconstructed the lives of these widows, particularly those with dependent children. This paper discusses the range of survival strategies used. It presents statistical evidence from official records, and adds vignettes of the lives of a handful of widows whose strategies can be explored more completely using additional historical sources.

China has had very active markets for both the sale and the rental of land since Song times (960–1279), if not longer. By the sixteenth century, most of the institutional arrangements that would characterize these markets until 1949 were in place. These institutions differed sharply from those of emerging land markets in early modern Western Europe: in particular, government played a lesser role in adjudicating disputes over land contracts, and customary arrangements included features that (a) gave some sellers of land claims on purchasers that could last for many years and (b) gave some tenants, especially in South and East China, very strong usufruct rights, which themselves became a form of tradable property. However, despite these and other differences from Western models, Chinese land markets were quite efficient, and provided the incentives needed for a very productive agriculture; secure tenants, for instance, responded to their strong position by behaving like owners and investing heavily in improving the land.

Based on archival research in several Italian city-states, this article examines medieval prison life, its attendant pains, and inmate coping strategies by substantially engaging the variety of scholarship on modern incarceration. It demonstrates the limited degree to which current hardships overlap with those of earlier forms of captivity, and underscores the diversity of inmates' social positions in both eras. Medieval prisoners were marginalized, but they avoided social liminality (a major present-day risk) largely thanks to their visibility, accessibility, and frequent interaction with free society.

Typologies of marriage patterns in early modern Europe have been formulated by John Hajnal and Peter Laslett. However, demographic and anthropological studies have noticed that marriage patterns in the Balkan area have exhibited such great variability that it is difficult to classify them in any of the categories proposed by Laslett. This article examines the marriage patterns in Greece and some of her island populations in the time-span of the twentieth century. Although the marriage patterns examined do not conform to any pre-defined typology, it seems that up to the first half of the twentieth century the pattern of mainland Greece constituted an intermediate case between the West and the East European marriage patterns but that that on the islands was totally different. The marriage patterns on the Ionian Islands had more features in common with the West European pattern, while the marriage pattern of the Cyclades reveals certain characteristics (but not all) of the Mediterranean pattern.

This article examines the extent of compliance with the Clandestine Marriages Act 1753 through three parish studies. It demonstrates that the vast majority of the sample cohort of parents whose children were baptized in church, and indeed of couples living together, had married in church as required by the 1753 Act, and shows how the proportion of marriages traced rises as more information about the parties becomes available. Through a study of settlement examinations, the article posits an explanation of why some marriages have not been traced, and argues that researchers should be cautious in inferring non-compliance from the absence of a record in a specific parish. It is also argued that the reason for such high rates of compliance has less to do with the power of statute and more to do with the fact that the 1753 Act was not such a radical break with the past as has been assumed.

In the immediate aftermath of the First World War a variety of commentators in England expressed concern that men returning from the war had become so brutalized and inured to violence that their behaviour would continue to be violent at home. But, while the stage was set for a ‘moral panic’ with the brutalized veteran as the new folk devil, no such panic materialized. This essay makes a detailed study of two contrasting newspapers to assess how violent crime was assessed and interpreted after the war. It notes an increase in the use of the concept of the ‘unwritten law’ (the traditional ‘right’ claimed by many men to chastise a disrespectful wife or a man who despoiled or dishonoured a wife) in the courts and the press, probably as an element in re-establishing pre-war gender roles. It also describes how the idea of shell-shock was deployed as a defence in criminal cases, something that probably contributed to a popular recognition that men might suffer mental breakdowns as easily as women. In conclusion, it suggests some of the factors that may have inhibited the press in identifying the violent veteran as a new folk devil.

Little is known about the lives of criminal offenders prior to their incarceration in past time. Knowing the background of offenders, however, may explain why they broke the law. This article explores young offenders in the Sundsvall region of Sweden, 400 kilometres north of Stockholm, an area with a booming sawmill-based economy in nineteenth-century Sweden. First, using prison registers, large-scale structural concepts are employed to explain the increasing number of incarcerations of young people reported during the period 1840–1880. Second, to uncover the offenders' demographic backgrounds and their socio-economic circumstances when arrested, they are identified in Swedish parish registers digitized by the Demographic Data Base (DDB) at Umeå University. These sources permit the application of retrospective life-course perspectives that are increasingly applied in modern criminology. These perspectives show that offenders were not primarily migrants or of poor origin, but that they frequently came from the region. Thus their parents were often also present in the community. In providing informal social control these characteristics – being local and having at least one parent nearby – are thought to lead to lower levels of criminality and imprisonment, but they were of little effect in preventing crime or incarceration. This study thus challenges the view of the criminal in past time as a lone individual arrested in an unfamiliar settings. Among the few female offenders observed, however, these factors were more typical; although gender accounts for low levels of criminality, their isolation and poverty did lead some women to theft.
