This article criticizes the standard way philosophers pose issues about the core practices of criminal justice institutions. Attempting to get at some of the presuppositions of posing these issues in terms of punishment, I construct a revised version of Rawls's ‘telishment’ case, a revision based on actual features of contemporary criminal justice practices in the USA. In addressing the implications of ‘racialment’, as I call it, some connections are made to current philosophical discussions about race. I conclude with brief remarks about the importance of race to philosophical discussion as such.

If we were required to sacrifice our own interests whenever doing so was best overall, or prohibited from doing so unless it was optimal, then we would be mere sites for the realization of value. Our interests, not ourselves, would wholly determine what we ought to do. We are not mere sites for the realization of value – instead we, ourselves, matter unconditionally. So we have options to act suboptimally. These options have limits, grounded in the very same considerations. Though not merely such sites, you and I are also sites for the realization of value, and our interests (and ourselves) must therefore sometimes determine what others ought to do, in particular requiring them to bear reasonable costs for our sake. Likewise, just as my moral status grounds a requirement that others show me appropriate respect, so must I do to myself.

A recurring objection confronting utilitarianism is that its dictates require information that lies beyond the bounds of human epistemic wherewithal. Utilitarians require reliable knowledge of the social consequences of various policies, and of people's preferences and utilities. Agreeing partly with the sceptics, I concur that the general rules of thumb offered by social science do not provide sufficient justification for the utilitarian legislator to rationally recommend a particular political regime, such as liberalism. Actual data about human preference-structures and utilities is required to bridge this evidentiary gap. I offer two arguments to support the availability of such information. First, I contend that ordinary human beings have a clear method of epistemic access to reliable information about commensurable preference-structures. Second, in an attempt to shift the onus of philosophic argument, I show that the utilitarian legislator's requirements do not differ in kind from those implicitly called upon by the sceptical deontic liberal.

Henry Sidgwick shared many of the feminist concerns of John Stuart Mill and was an active reformer in the cause of higher education for women, but his feminism has never received the attention it deserves and he has in recent times been criticized for promulgating a masculinist epistemology. This essay is a prolegomenon to a comprehensive account of Sidgwick's feminism, briefly setting out various elements of his views on epistemology, equality, gender, and sexuality in order to provide some initial sense of how he carried on and developed the Millian project.

The ‘non-identity problem’ raises a well-known challenge to the person-affecting view, according to which an action can be wrong only if it affects someone for the worse. In a recent article, however, Thomas D. Bontly proposes a novel way to solve the non-identity problem in person-affecting terms. Bontly's argument is based on a contrastive causal account of harm. In this response, we argue that Bontly's argument fails even assuming that the contrastive causal account is correct.

Recent attempts to defend Mill's account of higher and lower pleasures have overlooked a critical flaw in Mill's argument. Mill considers the question of pleasure and preference as an empirical one, but the evidence he appeals to is inconclusive. Yet, this distinction plays an essential role in Mill's utilitarianism because Mill uses this evidence to support his argument that most people actually prefer pleasures resulting from higher faculties over pleasures resulting from lower faculties. If this proves to be insufficient, then Mill's claim that these pleasures are clearly of a higher quality than others is left unsubstantiated. This article highlights the problematic nature of Mill's evidence, thereby exposing a significant problem for his, and for any utilitarian system which assumes Mill's distinction without providing additional argumentation for it.

Contemporary population ethics is dominated by views that aggregate by summing, whether of well-being or of some construct based on well-being. In contrast, average well-being is generally considered axiologically irrelevant. To many of us, however, the number of future people does not seem important, as long as it is sufficient to enable rich and varied life experiences, and as long as the population continues throughout time. It therefore seems relatively plausible to aggregate future well-being by averaging. In particular, it seems plausible to value high average well-being at any particular time, and to do so for all future times. I present a time-sensitive version of the Average View that underpins such axiological intuitions. I also address a series of issues and objections that confront such a view.

In this article I show the shortcomings of autonomy-based justifications for exemptions from paternalism and appeal to the value of settling to defend an alternative well-being-based justification. My well-being-based justification, unlike autonomy-based justifications, can (1) explain why adults but not children are exempt from paternalism; (2) show which kinds of paternalism are justified for children; (3) explain the value of the capacity of autonomy; (4) offer a plausible relationship between autonomy and exemption from paternalism; and (5) give political philosophers a justification for exempting persons from paternalism even if broad scepticism about the capacity for autonomy is justified.

A number of philosophers from Hobbes to Mill to Parfit have held some combination of the following views about the Golden Rule: (a) It is the cornerstone of morality across many if not all cultures. (b) It affirms the value of moral impartiality, and potentially the core idea of utilitarianism. (c) It is immune from evolutionary debunking, that is, there is no good naturalistic explanation for widespread acceptance of the Golden Rule, ergo the best explanation for its appearance in different traditions is that people have perceived the same non-natural moral truth. De Lazari-Radek and Singer employ all three of these claims in an argument meant to vindicate Sidgwick's ‘principle of universal benevolence’. I argue that the Golden Rule is the cornerstone of morality only in Christianity, it does not advocate moral impartiality, and there is a naturalistic explanation for why versions of the Golden Rule appear in different traditions.

I continue my argument that Millian qualitative superiorities are infinite superiorities: one pleasant feeling, or type of pleasant feeling, is qualitatively superior to another in Mill's sense if and only if even a bit of the superior is more pleasant (and thus more valuable) than any finite quantity of the inferior, however large. This gives rise to a hierarchy of higher and lower pleasures such that a reasonable hedonist always refuses to sacrifice a higher for a lower irrespective of the finite amounts of each. Some indication of why this absolute refusal may be reasonable is provided in the course of outlining the content of the Millian hierarchy. It emerges that Mill's hedonistic utilitarianism has an extraordinary structure because it gives absolute priority over competing considerations to a code of justice that distributes equal rights and correlative duties for all. His utilitarianism also recognizes that certain aesthetic and spiritual pleasures may be qualitatively superior even to the pleasant feeling of security associated with the moral sentiment of justice. Thus, for instance, a noble individual may reasonably choose to waive his own rights so as to perform beautiful supererogatory actions that provide great benefits for others at the sacrifice of the right-holder's own vital interests.

A central claim in abortion ethics is what might be called the Harm Claim – the claim that abortion harms the fetus. In this article, we put forward a simple and straightforward reason to reject the Harm Claim. Rather than invoking controversial assumptions about personal identity, or some nonstandard account of harm, as many other critics of the Harm Claim have done, we suggest that the aborted fetus cannot be harmed for the simple reason that it does not occupy any well-being level.

According to Jeremy Bentham's account of happiness, pleasure is understood as homogeneous, without qualitative differences between pleasures, and the relation between pleasure and its objects is understood as morally and psychologically arbitrary. John Stuart Mill's ‘mental crisis’ emerged as he realized the psychological impossibility of living according to this view. His recovery was aided by engagement with the poetry of Wordsworth, through which he developed the notion that the cultivation of character and sentiments is an essential element of a good life. I aim to explore Mill's engagement with Wordsworth, and shed light on how Mill felt able to reconcile hedonic utilitarianism with his new view of the ‘inner life’ of the individual.

Henry Sidgwick's Practical Ethics offers a novel approach to practical moral issues. In this article, I defend Sidgwick's approach against recent objections advanced by Sissela Bok, Karen Hanson, Michael S. Pritchard, and Michael Davis. In the first section, I provide some context within which to situate Sidgwick's view. In the second, I outline the main features of Sidgwick's methodology and the powerful rationale that lies behind it. I emphasize elements of the view that help to defend it, noting some affinities it has with those of the later Rawls. In the third section, I indicate how it promises to help alleviate some difficulties facing modern practical ethics. In the fourth, I respond to Bok's objections. I argue that her own work on practical ethics has some similarities to Sidgwick's which should make them friends, not enemies. In the fifth section, I respond to Hanson, Pritchard and Davis.
