Ms Fatima Gailani was appointed as the President of the Afghan Red Crescent Society in 2005. She was born in 1954 in Kabul and is the daughter of Pir Sayed Ahmed Gailani, the leader of the National Islamic Front of Afghanistan, who fought against the Soviet occupation of Afghanistan in the 1980s. She lived in exile during the Soviet invasion of Afghanistan and acted as spokesperson in London for the Afghan Mujahideen. After her return to Afghanistan she was chosen as a delegate to the Emergency Loya Jirga (Grand Council) of June 2002 and was appointed as a constitution-drafting and -ratifying commissioner. Ms Gailani is the author of two books (The Mosques of London and a biography of Mohammad Musa Shafiq).

The armed conflict in Afghanistan since 2001 has raised manifold questions pertaining to the humanitarian rules relative to the conduct of hostilities. In Afghanistan, as is often the case in so-called asymmetric conflicts, the geographical and temporal boundaries of the battlefield, and the distinction between civilians and fighters, are increasingly blurred. As a result, the risks for both civilians and soldiers operating in Afghanistan are high. The objective of this article is to assess whether – and if so how much – the armed conflict in Afghanistan has affected the application and interpretation of the principles of distinction, proportionality, and precaution – principles that form the core of legal rules pertaining to the conduct of hostilities.

David Kilcullen is a leading expert on counter-insurgency policy. He served twenty-four years as a soldier, diplomat, and policy advisor for the Australian and United States governments. He was Special Advisor to the US Secretary of State in 2007–2009 and Senior Advisor to General David Petraeus in Iraq in 2007. He has provided advice at the highest levels of the Bush and Obama administrations, and has worked in peace and stability operations, humanitarian relief, and counter-insurgency environments in the Asia-Pacific region, Middle East, South Asia, and Africa. He is a well-known author, teacher, and consultant, advising the US and allied governments, international organizations, non-governmental organizations, and the private sector. His best-selling books The Accidental Guerrilla and Counterinsurgency are used worldwide by civilian government officials, policymakers, and military and development professionals working in unstable and insecure environments. Mr Kilcullen holds a PhD from the University of New South Wales. He is the founder and CEO of the consultancy firm Caerus Associates.

This article assesses the implications of six megatrends for humanitarian action in the future, including changes in demography, technology and science, economics, political power, climate, and patterns of conflict. The interaction of these trends suggests a particularly complex landscape for future humanitarian response. For example, conflict in the future is more likely to take place in cities that are growing as a result of economic and environmental factors. Social media are contributing to both political change and humanitarian response, while changes in global political and economic power are likely to influence the way in which the international humanitarian system is financed and supported.

Armed actors dominate contemporary conflict environments dramatically. Their degree of dispersion, influence, and effect on international politics make it necessary to establish strategies for interaction with them. This article makes a contribution by assessing particular strategies and their suitability and applicability with regard to specific actors. First, it delineates options for dealing with armed actors based on three perspectives from international relations theory: realist, institutionalist, and constructivist. Second, it matches these perspectives to the capabilities of international actors. Finally, it offers an assessment of the difficulties that arise from the plurality of forms of armed actors, as well as of external actors.

An effective legal regime governing the actions of armed non-state actors in Afghanistan should encompass not only international humanitarian law but also international human rights law. While the applicability of Common Article 3 of the 1949 Geneva Conventions to the conflict is not controversial, how and to what extent Additional Protocol II applies is more difficult to assess, in particular in relation to the various armed actors operating in the country. The applicability of international human rights law to armed non-state actors – considered by the authors as important, particularly in Afghanistan – remains highly controversial. Nevertheless, its applicability to such actors exercising control over a population is slowly becoming more accepted. In addition, violations of peremptory norms of international law can also directly engage the legal responsibility of such groups.

For this issue on understanding armed groups, the Review considered it important to invite someone who could give the inside perspective of an armed group. Minister Ali Ahmad Jalali, currently Distinguished Professor at the National Defense University in Washington, DC, is uniquely placed to do so in the context of Afghanistan: he has at once the experience of a former member of the Mujahideen during the war against the Soviet Union, a former Colonel in the Afghan National Army, and a former Minister of the Interior for Afghanistan from 2003 to 2005. Minister Jalali has published extensively on political, military, and security issues in Afghanistan, Iran, and Central Asia.

The following article focuses on the Islamic Emirate of Afghanistan Rules for the Mujahideen** to determine their conformity with the Islamic jus in bello. This code of conduct, or Layha, for Taliban fighters highlights limiting suicide attacks, avoiding civilian casualties, and winning the battle for the hearts and minds of the local civilian population. However, it has altered rules or created new ones for punishing captives that have not previously been used in Islamic military and legal history. Other rules disregard the principle of distinction between combatants and civilians and even allow perfidy, which is strictly prohibited in both Islamic law and international humanitarian law. The author argues that many of the Taliban rules have only a limited basis in, or are wrongly attributed to, Islamic law.

This article identifies two countervailing sets of norms – one promoting humanitarian engagement with non-state armed groups (NSAGs) in armed conflict in order to protect populations in need, and the other prohibiting such engagement with listed ‘terrorist’ groups in order to protect security – and discusses how this conflict of norms might affect the capacity of humanitarian organizations to deliver life-saving assistance in areas under the control of one of these groups. Rooted in international humanitarian law (IHL), the first set of norms provides a basis for humanitarian engagement with NSAGs in non-international armed conflict for the purpose of assisting populations under their control and promoting compliance with the rules of IHL. The second set of rules attempts to curtail financial and other forms of material support, including technical training and co-ordination, to listed ‘terrorist’ organizations, some of which may qualify as NSAGs under IHL. The article highlights counter-terrorism regulations developed by the United States and the United Nations Security Council, though other states and multilateral bodies have similar regulations. The article concludes by sketching ways in which humanitarian organizations might respond to the identified tensions.

In the foreseeable future, it is more than likely that the types, dimensions, and dynamics of crisis drivers will increase dramatically, in some instances exponentially. While a growing number of organizations with humanitarian roles and responsibilities sense that such changes are afoot, few have looked at how these might fundamentally affect not only what they do but also how they do it. This article suggests that it is time for humanitarian organizations to look far more systematically at the transformational factors that will increase disaster vulnerabilities around the world and also the opportunities that exist to mitigate them. The article notes that some of the most transformative factors affecting humanitarian action will be the result of new political structures in the post-Western hegemonic world and the growing political centrality of humanitarian crises. The consequences of these and other transformative factors mean that those with humanitarian roles and responsibilities will have to be far more anticipatory and adaptive than is the case today. They will have to pay far greater attention to innovation and innovative practices and significantly expand the ways in which and with whom they collaborate.

Have the various profound changes that have affected the world, and particularly its geostrategic dimensions, since the end of the Cold War radically altered the nature of conflicts? Twenty years after the collapse of the Soviet Union and ten years after the destruction of the twin towers in New York, there is an apparent degree of continuity in the resilience of former centres of unresolved conflicts and of armed groups involved in them. Nonetheless, whereas most armed conflicts can today be classified as ‘intra-state’, the general context has changed to the extent that reference is now made to the phenomenon of ‘new wars’. Increasingly inacceptable economic and political imbalances along with globalization, environmental damage and its consequences or the emergence of large-scale conflicts triggered by organized crime are some of the perils already affecting the nature of today's conflicts or potentially defining those of the future. As the period dominated by jihadist groups with a universalist vocation possibly draws to an end, the current trend seems to be towards a new generation of guerrilla fighters who stand to benefit, in particular, from the erosion of the nation-state and from geopolitical convulsions arising from the post-colonial legacy as the starting point for intensely zealous and violent long-term ventures. The impact of globalization could cause a flare-up of some existing conflicts that are currently limited in scope while the international community struggles to redefine other rules and to adapt them to the new dialectic of war and peace.

The organizational structures of armed groups, whether they develop by accident or by design, affect their strategic choices during the conflict and their ability to enter peace agreements. This article explains how frequently encountered structures such as centralized, decentralized, networked, and patronage-based ones affect strategic choices for the organization and its opponents. Only centralized organizations can make use of sophisticated strategies such as ‘divide and conquer’, ‘co-option’, and ‘hearts and minds’, and can engage in successful peace agreements. Centralized armed organizations that do not have a safe haven within the contested territory tend to be very vulnerable, however, which makes peace less attractive to their opponents and explains in part why long-lasting peace agreements between such groups and their opponents are rare.

The evolving global environment in which humanitarian actors operate is posing profound challenges, both in terms of the increasing complexity of major crises and their impact on affected people, and in terms of the changes within the humanitarian sector itself as it tries to respond. This article gives one perspective of what the International Committee of the Red Cross (ICRC) considers to be some of the key challenges facing humanitarian action now and in the coming years, and how the institution aims to address these challenges while remaining faithful to its fundamental principles of impartiality, neutrality, and independence.

The Layha is the code of conduct (manual) and regulations of the Mujahids of the Islamic Emirate. The following document is the second edition of the Layha, published in 2010. It has been originally written in Pashto and translated into English for informational use by the International Committee of the Red Cross. This is not an official translation. The topic of participation of armed groups in the development of legal instruments binding them is particularly important and needs to be addressed urgently. Many scholars and organizations have advocated recently for the participation of armed groups in the development of legal instruments binding them, with a view to ensuring their adhesion to the law. However, practical and legal considerations seem to make this participation extremely difficult in practice. Creative solutions have to be found. After reviewing five main reasons why armed groups should be involved in the advancement of the law governing armed conflicts, this article offers a brief overview of selected means by which armed groups should be engaged in the creation of future norms, as well as in the interpretation and contextualization of existing norms.
