UN human rights mechanisms continue to proliferate, producing numerous decisions and voluminous reports. This article reviews the ways in which such mechanisms apply international humanitarian law, including the law of Geneva and the law of The Hague. In doing so, it focuses mainly on the practice of the rapporteurs appointed by the UN Commission on Human Rights to investigate the human rights situations in specific countries and on that of the thematic rapporteurs and working groups which the Commission has entrusted with monitoring specific types of serious human rights violations wherever they occur, in particular the Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions and the Representative of the Secretary-General on Internally Displaced Persons, whose mandates most often lead them to examine abuses occurring in the context of armed conflicts. Reference is also made to two innovative mechanisms which functioned in El Salvador: the first UN-sponsored “truth commission” and the first human rights monitoring body established as part of a comprehensive mechanism for monitoring compliance with a UN-sponsored peace agreement. Certain observations made by treaty monitoring bodies are also mentioned.

The rise in the number of older prisoners in many nations has been described as a correctional “ageing crisis” which poses an urgent financial, medical and programmatic challenge for correctional health-care systems. In 2016, the International Committee of the Red Cross hosted a conference entitled “Ageing and Imprisonment: Identifying the Needs of Older Prisoners” to discuss the institutional, legal and health-care needs of incarcerated older adults, and the approaches some correctional facilities have taken to meeting these needs. This article describes some of the challenges facing correctional systems tasked with providing health care to older adults, highlights some strategies to improve their medical care, and identifies areas in need of reform. It draws principally on research and examples from the United States to offer insights and recommendations that may be considered in other systems as well.

Armed non-state actors are involved in most armed conflicts today, yet international law provides few mechanisms to ensure that they comply with humanitarian norms applicable to them. In particular, monitoring and verification mechanisms that address the conduct of armed non-state actors rarely appear in multilateral treaties, and, even when they do, are weak and not applied in practice. Over the past few years, a number of alternative mechanisms have been developed to better monitor respect of humanitarian norms during internal armed conflicts and verify allegations of violations. This article examines the strength of these various mechanisms and then focuses on the Deed of Commitment, an innovative instrument developed by the Swiss-based non-governmental organization Geneva Call, to hold armed non-state actors accountable. Experience with the Deed of Commitment on the prohibition of anti-personnel mines shows that these alternative mechanisms can be effective in ensuring better compliance with at least some humanitarian norms.

The participation of women in the 1994 Rwandan genocide should be considered in the context of gender relations in pre-genocide Rwandan society. Many ‘ordinary’ women were involved in the genocide but, overall, committed significantly fewer acts of overt violence than men. Owing to the indirect nature of women's crimes, combined with male ‘chivalry’, women may be under-represented among those pursued for genocide-related crimes, despite the broad conception of complicity in Rwanda's Gacaca Law. Women in leadership positions played a particularly important role in the genocide, and gendered imagery, including of the ‘evil woman’ or ‘monster’, is often at play in their encounters with the law.

The revolution in biology, including advances in genomics, will lead to rapid progress in the treatment of mental illness by advancing the discovery of highly specific ligands that affect specific neurological pathways. The status of brain science and its potential for military application to enhance soldier performance, to develop new weapons and to facilitate interrogation are discussed. If such applications are pursued, they will also expand the options available to torturers, dictators and terrorists. Several generic approaches to containing the malign applications of biology are shown, and it is concluded that success or failure in doing so will be significantly dependent on the active involvement of the scientific and medical communities.

This article provides a first attempt at analysing the complex set of issues around remote management practices in insecure environments and their increased use. It looks at definitions and reviews existing published and grey literature on remote management and related practices. It tries to situate remote management in the evolving context of post-Cold War strategies of dealing with conflict and crisis. On the basis of interviews with a cross-section of aid workers, senior headquarters managerial and policy staff, donors, and research institutions, it provides an assessment of current remote management practices, with a particular focus on Afghanistan and Somalia, and their implications for the future of humanitarian action.

Any body or institution dealing with the missing persons issue will interact in one way or another with transitional justice proceedings, if only to examine the possibility of sharing relevant information gathered. The question becomes even more acute when international tribunals intervene in the national context where transitional justice mechanisms are operating. The authors look at the ways in which transitional justice mechanisms may support the right of families to know the fate of their relatives, and how work to resolve the missing persons issue can be reconciled with an effective fight against impunity.

This article examines the meaning and potential usefulness of a ‘gender perspective’ on international humanitarian law (IHL). In order to do so, it considers a number of ‘gendered’ themes found within IHL, including the role of women as combatants, and the gendered use of sexual violence during times of armed conflict. The authors suggest that further development and understanding of a gender perspective will contribute to the resilience and effectiveness of IHL as a system of law, and will strengthen the protection of those who are victimized and disempowered during times of war.

The people of the Pacific region have suffered widespread and persisting radioactive contamination, displacement and transgenerational harm from nuclear test explosions. This paper reviews radiation health effects and the global impacts of nuclear testing, as context for the health and environmental consequences of nuclear test explosions in Australia, the Marshall Islands, the central Pacific and French Polynesia. The resulting humanitarian needs include recognition, accountability, monitoring, care, compensation and remediation. Treaty architecture to comprehensively prohibit nuclear weapons and provide for their elimination is considered the most promising way to durably end nuclear testing. Evidence of the humanitarian impacts of nuclear tests, and survivor testimony, can contribute towards fulfilling the humanitarian imperative to eradicate nuclear weapons.

Inequality in arms, indeed, significant disparity between belligerents, has become a prominent feature of various contemporary armed conflicts. Such asymmetries, albeit not at all a new phenomenon in the field of warfare, no longer constitute a random occurrence of singular battles. As a structural characteristic of modern-day warfare asymmetric conflict structures have repercussions on the application of fundamental principles of international humanitarian law. How, for example, can the concept of military necessity, commonly understood to justify the degree of force necessary to secure military defeat of the enemy, be reconciled with a constellation in which one side in the conflict is from the outset bereft of any chance of winning the conflict militarily? Moreover, military imbalances of this scope evidently carry incentives for the inferior party to level out its inferiority by circumventing accepted rules of warfare. This article attempts tentatively to assess the repercussions this could have on the principle of reciprocity, especially the risk of the instigation of a destabilizing dynamic of negative reciprocity which ultimately could lead to a gradual intensification of a mutual disregard of international humanitarian law.

The proper management of the dead from catastrophes is an essential component of humanitarian response, together with the rescue and care of survivors and the provision and rehabilitation of essential services. Sadly, insufficient recognition of the importance of ensuring proper management of the dead and of caring for the needs of the bereaved, coupled with the frequent collapse of forensic services in the aftermath of catastrophes, contribute to perpetuating the tragedy and trauma suffered by survivors forever unable properly to bury and mourn their dead. In 2006 the Pan American Health Organisation (PAHO) and the International Committee of the Red Cross (ICRC), together with the World Health Organisation (WHO) and the International Federation of Red Cross and Red Crescent Societies (IFRC), published guidelines for the management of the dead, to help improve the management of the dead after catastrophes. The publication, Management of Dead Bodies after Disasters: A Field Manual for First Responders, offers practical and simple recommendations to non-specialists for the proper and dignified management of the dead in catastrophes and for the care of bereaved relatives. It also helps to dispel the principal myth which often complicates this difficult task: the unfounded association of cadavers with epidemics. The manual has proven to be a valuable tool for first responders, including humanitarian workers, for disaster response and preparedness in various operational contexts.

At the intersection of new weapon technologies and international humanitarian law, so-called “non-lethal” weapons have become an area of particular interest. This article analyses the relationship between “non-lethal” weapons and international law in the early 21st century by focusing on the most seminal incident to date in the short history of the “non-lethal” weapons debate, the use of an incapacitating chemical to end a terrorist attack on a Moscow theatre in October 2002. This tragic incident has shown that rapid technological change will continue to stress international law on the development and use of weaponry but in ways more politically charged, legally complicated and ethically challenging than the application of international humanitarian law in the past.

The Advisory Opinion of the International Court of Justice represents the first time that the Court's judges have been called upon to analyse in some detail rules of international humanitarian law. Other instances, for example, the Nicaragua case, involved nowhere near such an extensive analysis. The Advisory Opinion is therefore of particular interest in that it contains important findings on the customary nature of a number of humanitarian law rules and interesting pronouncements on the interpretation of these rules and their relationship with other rules. Most judges based their final decision on the legality of the threat or use of nuclear weapons on teleological interpretations of the law, choosing either the right of self-defence as being the most fundamental value, or the survival of civilization and the planet as a whole as paramount. Unfortunately, space does not permit a comment on these highly important analyses of the underpinnings of humanitarian law and its purpose in the international order. Therefore, rather than focusing primarily on the Court's conclusion as to the legality of the threat or use of nuclear weapons, this short comment will concentrate on the various pronouncements made on humanitarian law rules. Reference to the Court's finding on the legality of the use of nuclear weapons will only be made from the point of view of how it has contributed to the interpretation of those rules. For this purpose, reference will be made not only to the Advisory Opinion as such (hereafter referred to as the “Opinion”), but also to the various Separate and Dissenting Opinions.

Recent years have witnessed an increase in the number of private military and security companies (PMCs/PSCs) operating in situations of armed conflict, as well as a change in the nature of their activities, which are now increasingly close to the heart of military operations and which often put them in close proximity to persons protected by international humanitarian law. It is often asserted that there is a vacuum in the law when it comes to their operations. In situations of armed conflict, however, there is a body of law that regulates both the activities of the staff of PMCs/PSCs and the responsibilities of the states that hire them. Moreover, other states also have a role to play in promoting respect for international humanitarian law by such companies. This article examines the key legal issues raised by PMCs/PSCs operating in situations of armed conflict, including the status of the staff of these companies and their responsibilities under international humanitarian law; the responsibilities of the states that hire them; and those of the states in whose territory PMCs/PSCs are incorporated or operate.

This article presents an overview of the various mechanisms to improve the situation of people affected by armed conflict. Some are anchored in international humanitarian law, but numerous actors are increasingly contributing to its implementation outside the original framework established for that purpose. Human rights monitoring bodies, the diverse organs and agencies of the United Nations and regional organizations, and governmental and non-governmental organizations are seeking to address situations of armed conflict. However, humanitarian action unattached to any political agenda and combining protection and assistance is often the only remedy for the plight of the victims of armed conflicts.
