Although the decision of the House of Lords in Kleinwort Benson Ltd. v. Lincoln C.C. [1998] 3 W.L.R. 1095 has done much to rationalise the law on restitution of mistaken payments, the law remains unclear in certain important respects. Two recent decisions have, however, sought to clarify the law.
