  • Kant defined 'Right' (Recht) as the condition that obtains among a population of physically embodied persons capable of setting their own ends who live on a finite surface and therefore cannot avoid interaction with each other if each is as free to set their own ends as is consistent with the freedom of all to do the same. He regarded this rational idea, heir to the traditional idea of 'natural Right, as the test of the legitimacy of the laws of any actual state, or 'positive Right.' He clearly considered Right to be part of morality as a whole, namely the coercively enforceable part, as contrasted to Ethics, which is the non-coercively enforceable part of morality. Some have questioned whether Right is part of morality, but this Element shows how Kant's "Universal Principle of Right" follows straightforwardly from the foundational idea of Kant's moral philosophy as a whole.

  • Over the years, the US has intervened covertly in many countries to remove dictators, subvert elected leaders, and support coups. Explanations for this focus on characteristics of target countries or strategic incentives to pursue regime change. This Element provides an account of domestic political factors constraining US presidents' authorization of covert foreign-imposed regime change operations (FIRCs), arguing that congressional attention to covert action alters the Executive's calculus by increasing the political costs associated with this secretive policy instrument. It shows that congressional attention is the result of institutional battles over abuses of executive authority and has a significant constraining effect independent of codified rules and partisan disputes. These propositions are tested using content analysis of the Congressional Record, statistical analysis of Cold War covert FIRCs, and causal-process evidence relating to covert interventions in Chile, Angola, Central America, Afghanistan, etc.

  • Cat Island, South Carolina, was once the location of slave trade activities, including capture of Native Americans for export and the rise of plantations in the Lowcountry for indigo and rice production, from the sixteenth to mid-nineteenth centuries. This Element examines the Hume Plantation Slave Street Project led by the author, and archaeological evidence for hoodoo magic and ritual practices involving “white magic” spells used for protection and treatments for illness and injury, and, alternately, for 'black magic,' in spells used to exact harm or to kill. This Element is intended as a contribution to the collective knowledge about hoodoo magic practices in the Lowcountry, centered on the Hume Plantation grounds during this period of American history. It is an attempt to examine how attitudes and practices may have changed over time and concludes with a look at select contemporary hoodoo activities conducted in local cemeteries.

  • Courts are often thought of as protectors of minority rights. What happens when the composition of courts changes such that politically disadvantaged groups expect a less favorable reception? This Element examines whether the increasing conservatism of the US Supreme Court during Donald Trump's presidency changed the behavior of litigants and amicus curiae. The authors test whether membership changes led to reduced filings by individuals and organizations representing marginalized groups and increased filings by businesses and conservative states and interest groups. The authors find substantial reductions in participation by the most politically disadvantaged and substantial increases in participation by the most conservative groups.

  • Based on six-year fieldwork across China including over 200 in-depth interviews, this book provides an ethnographic account of how hundreds of millions of Chinese homeowners practice democracy in and beyond their condominium complexes. Using interviews, survey data, and a comprehensive examination of laws, policies and judicial decisions, this book also examines how the party-state in China responds to the risks and benefits brought by neighborhood democratization. Moreover, this book provides a framework to analyze different approaches to the authoritarian dilemma facing neighborhood democratization which may increase the regime's legitimacy and expose it to the challenge of independent organizations at the same time.   • The ecological crisis is the result of modernity's coloniality. The Moderns considered the Earth as 'natural resources' at their disposal. Their colonial vision of nature was complemented by that of nonmodern cultures like Byzantium and pre-Columbian America as passive or primitive, respectively. For the Moderns, the Byzantines were the 'librarians of humanity,' an inert repository of Greco-Roman knowledge, unable to produce their own. Byzantium's inertia was matched by that of nature, both reservoirs of epistemic and material resources. Thanks to those “librarians,” the supposedly inexhaustible supply of natural resources, and the epistemic and material riches of indigenous America, the Moderns believed they were inaugurating an epoch of intellectual maturity and infinite growth. Today, the enduring negative view of Byzantium and the ecological crisis confirm that we remain entangled in modernity's coloniality. We should decolonize both history and nature. To mitigate humanity's existential threat, modernity must be rethought and overcome.

  • This Element is about the social dimensions of scientific knowledge. The first section asks in what ways scientific knowledge is social. The second section develops a conception of scientific knowledge that accommodates the insights of the first section, and is consonant with mainstream thinking about knowledge in analytic epistemology. The third section asks under what conditions we can tell, in the real world, that a consensus in a scientific community amounts to shared scientific knowledge, as characterized in the second section, and how to deal with scientific dissent. The fourth section reviews the ways epistemic and social elements mutually interact to coproduce scientific knowledge. This Element engages with literature from philosophy of science and social epistemology, especially social epistemology of science, as well as Science, Technology, and Society (STS), and analytic epistemology.   • This Element addresses the opportunities and constraints operating on monotheistic peacebuilding, focusing on the three Abrahamic faiths, Christianity, Judaism, and Islam, which share a common origin. These opportunities and constraints are approached through what the volume calls 'the paradox of monotheism'. Monotheism is defined by belief in one omnipotent, benign, and loving God, but this God does not or cannot prevent violence, war, and conflict. Moreover, monotheism can actually promote conflict between the Abrahamic faiths, and with other world religions, giving us the puzzle of holy wars fought in God's name. The first section of the Element outlines the paradox of monotheism and its implications for monotheistic peacebuilding; the second section addresses the peacebuilding efforts of three Abrahamic monotheistic religions and the constraints that operate as a result of the paradox of monotheism. This paradox tends to limit monotheistic peacebuilding to inter-faith dialogue, which often does not go far enough.

  • This Element investigates the historical and systemic roots of hedge-fund activism. It argues that the spirit of the New Deal financial regulations was subverted in the 1980s and 1990s in the name of shareholder democracy and opened the door for the rise of hedge-fund activism. It analyzes the effects of regulatory reforms including the introduction of compulsory voting by institutional investors, proxy-voting rule changes that greatly facilitated aggregation of the proxy votes of institutional investors, and rules that allow hedge funds to draw effectively limitless alternative investments from institutional investors. This Element also evaluates the recent empirical research on hedge-fund activism and explains why shareholder activism has gone awry. It argues that the regulatory changes created a large vacuum in the arena of corporate voting that hedge-fund activists can effectively exploit for their own profits. It concludes with policy proposals for rebuilding the proxy-voting and engagement system.

  • This Element is the first monograph to focus on the presence and popularity of autofiction in contemporary theatre, a mode characterised by its mixture of autobiographical and fictional materials and generally associated with the cutting edge of literary fiction. To do so, it brings frameworks from literary and theatre studies to bear on a recent upsurge in plays that explicitly mobilise lived experience and its fictionalisation to political ends. Considering a comparative corpus of state-subsidised productions in Britain and Europe since the mid 2010s – both adaptations of literary works and plays written for the stage – this Element attends to autofiction's aesthetics and politics through its negotiation on stage of three conceptual binaries, each the focus of a section: fact/fiction, self/other, and inclusion/exclusion. By probing the mode's critical potential and pitfalls, it sheds light on the stakes of self-fictionalising practices in today's cultural markets and on the role of theatre therein.

But what was life like for everyday folk, those who gazed up at the palace rather than looking out from within its walls? In this book, Jeremy Hartnett offers a detailed view of an average Roman, an individual named Flavius Agricola. Though Flavius was only a generation or two removed from slavery, his successful life emerges from his careful commemoration in death: a poetic epitaph and life-sized marble portrait showing him reclining at table. This ensemble not only enables Hartnett to reconstruct Flavius' biography, as well as his wife's, but also permits a nuanced exploration of many aspects of Roman life, such as dining, sex, worship of foreign deities, gender, bodily display, cultural literacy, religious experience, blended families, and visiting the dead at their tombs.   • Objects of knowledge exist within material, immaterial, and conceptual worlds. Once the world is conceived from the perspective of others, the physical ontology of modern science no longer functions as a standard by which to understand other orderings of reality, whether from ethnographical or historical sources. Because premodern and non-western sources attest to a plurality of sciences practiced in accordance with different ways of worldmaking from that of the modern West, their study belongs to the history of science, the philosophy of science, and the sociology of science, as well as the anthropology of science. In Worldmaking and Cuneiform Antiquity, Francesca Rochberg extends an anthropology of science to the historical world of cuneiform texts of ancient Babylonia. Exploring how Babylonian science has been understood, she proposes a new direction for scholarship by recognizing the world of ancient science, not as a less developed form of modern science, but as legitimate and real in its own right.

  • Do private actors have constitutional duties? While traditionally only government actors are responsible for upholding constitutional rights, courts and constitution-makers increasingly do assign constitutional duties to private actors as well. Therefore, a landlord may have constitutional duties to their tenants, and a sports club may even have duties to its fans. This book argues that this phenomenon of applying rights 'horizontally' can be understood through the lens of republican political theory. Themes echoing such concepts as the common good and civic duty from republican thought recur in discourses surrounding horizontal application. Bambrick traces republican themes in debates from the United States, India, Germany, South Africa, and the European Union. While these contexts have vastly different histories and aspirations, constitutional actors in each place have considered the horizontal application of rights and, in doing so, have made republican arguments.

  • Biblical authors used wine as a potent symbol and metaphor of material blessing and salvation, as well as a sign of judgement. In this volume, Mark Scarlata provides a biblical theology of wine through exploration of texts in the Hebrew Bible, later Jewish writings, and the New Testament. He shows how, from the beginnings of creation and the story of Noah, wine is intimately connected to soil, humanity, and harmony between humans and the natural world. In the Prophets, wine functions both as a symbol of blessing and judgement through the metaphor of the cup of salvation and the cup of wrath. In other scriptures, wine is associated with wisdom, joy, love, celebration, and the expectations of the coming Messiah. In the New Testament wine becomes a critical sign for the presence of God's kingdom on earth and a symbol of Christian unity and life through the eucharistic cup. Scarlata's study also explores the connections between the biblical and modern worlds regarding ecology and technology, and why wine remains an important sign of salvation for humanity today.
