Chapter 6 discusses the circumstances involved in the consideration of adopting a provisional safeguard measure, as well as the requirements for its imposition, in particular the consideration of critical circumstances, an irreparable damage that would occur if no action were taken, and the issuance of a preliminary determination. The chapter also discusses the question of the timing of the adoption of these measures, their duration, the form that they could adopt and other issues derived from their application.

Summary

When the authorities are satisfied that there is sufficient evidence to justify the initiation of an anti-dumping investigation pursuant to Article 5, the Member or Members the products of which are subject to such investigation and other interested parties known to the investigating authorities to have an interest therein shall be notified and a public notice shall be given.
