This article explores the regulation of sex work in South Africa and follows the trajectory of the South African Law Reform Commission (SALRC) in investigating whether sex work should be decriminalized. The legal regulation of sex work is a hotly contested topic. South Africa currently criminalizes the selling and buying of sex, but policy reform has been on the cards since the SALRC launched its project on the topic in the early 2000s. As most sex work policy responses are grounded in feminist theory, the article analyses the main theoretical ideologies and questions the influence of these ideologies in structuring sex work law reform in the South African context. The author calls for a more inclusive understanding of feminism and sex work, and the need to acknowledge the importance of rights discourse in furthering political growth and protecting sex workers’ constitutional rights.

Disinformation has become a formidable challenge to the integrity of electoral processes as well as the internal political stability of many countries. This state of affairs has spurred a wave of new regulatory measures in several countries. From stringent rules governing dissemination of political advertisements via social media platforms to media literacy programmes, the past few years saw the introduction of legislative and non-legislative measures in many jurisdictions. Ethiopia is no exception in introducing measures to address the problem. This article examines Ethiopia's policy responses towards addressing the impact of disinformation on the integrity and credibility of elections. It argues that measures taken thus far in Ethiopia appear to address the impact of disinformation on national security and social harmony. As such, Ethiopia has not taken tailored measures to address the impact of disinformation on its democratic aspirations, particularly in holding free, fair and democratic elections.

Article 24(4) of the Constitution of Kenya qualifies the right to equality “to the extent strictly necessary for the application of” Islamic law “in matters relating to personal status, marriage, divorce and inheritance”. Section 3 of the Marriage Act provides that, although spouses have equal rights during marriage and at its dissolution, “the parties to an Islamic marriage shall only have the rights granted under Islamic law”. The Law of Succession Act states that it is generally not applicable to the estate of a deceased Muslim. In this article, the author examines case law from the Kadhi's Court, the High Court and the Court of Appeal on issues of Muslim marriages and inheritance. These cases illustrate, in some instances, the tensions between Islamic law and human rights.

It has partly been assumed that the constitutional obligation to pay compensation for expropriations is to blame for the slow pace at which land has been redistributed in South Africa. However, this assumption requires careful analysis and reflection, with reference to the imperfections of the policies and laws that set out to address landlessness, as well as the underlying theoretical approach to economic justice. This article questions the purpose for which land reform beneficiaries acquire land, with reference to the role that property should ideally fulfil for the landless. The article makes a number of observations to cast light on why the redistribution of land has been alarmingly slow, where inconsistencies and loopholes exist in the programme, and whether expropriations for nil compensation will make any difference in remedying existing failures in the redistribution programme.

Innovative services such as mobile payments are potentially transformative because they can increase access to financial services, especially in developing countries. However, such innovations can disrupt the financial services ecosystem, prompting regulators to respond in different ways. These regulatory responses often have a significant impact on the success of such innovative services. Using Nigeria's regulatory approach as a case study, this article highlights specific lessons that should inform future attempts at regulating mobile payments.

This article critically examines the admiralty jurisdiction of the Federal High Court of Nigeria in relation to claims arising from combined transport shipping. It questions the rationale for the continued circumscription of the court's admiralty jurisdiction to activities on navigable waters based on English law pedigree. It argues that, in the present era of containerization and combined transport shipping, it has become imperative to unshackle Nigerian courts from English antecedents that limit the admiralty jurisdiction of the court to activities on the high seas. The article identifies extant national legislation, a continental instrument and recent judicial authorities that provide the basis for expanding the Federal High Court's admiralty jurisdiction to accommodate the adjudication of claims derived from combined transport shipping beyond the locale of the high seas.
