This article challenges the prevailing interpretations of Hobbes's thought as providing only minimal protection for the natural right of individuals in political society. Natural right requires the protection of not just the subjects' lives, but their ability to live commodiously, and as a result the protection that natural right receives in political society places substantive constraints on the actions of the sovereign. When those entrusted with sovereign power overstep this constraint, they cease to be sovereign and the former subjects are returned to the state of nature to seek protection as each judges fit. I develop the substance of commodious living more thoroughly than similar analyses and demonstrate that this understanding is not limited to Leviathan but can be found in Hobbes's earlier political work as well.

In arguments for a more tolerant Hobbes, Leviathan's endorsement of “Independency” is often Exhibit A; however, the conditionals Hobbes attached have received little attention. These—and the dangers of “contention” and sectarian “affection” they identify—are essential for understanding Hobbes's views on toleration. Together, they express a vision of “difference without disagreement” in which the accommodation of diversity in religious worship and association depends on the suppression of disagreement through sovereign- and self-discipline over speech. This expressly antievangelical ideal of toleration as a civil silence about difference presents a challenge to the more tolerant Hobbes thesis, particularly in its recent “Erastian Independency” guise. It also raises deeper questions about what might be at stake in applying the labels of “intolerant” or “tolerant” to Hobbes today.

The account of law in Plato's Minos is on its surface strange. Law is both what “wants to be the finding out of what is” and “the finding out of what is.” It is a faculty in us like sight or hearing, and its stability requires that it be independent of us. It makes universal claims but always does so for a particular people in a particular place. Law must be grounded in what is beyond the law, and yet, once established, must assert its own final authority. Lawgivers must be at once above the law, almost a different species from those for whom they legislate, and, like everyone else, subject to the law. These ambiguities, indeed duplicities, are not so much defects of law to be resolved as indications of its fundamental nature. What follows is an account of this dual nature, especially in its necessary connection to poetry.

This article examines early modern English public houses and related period miscellany—broadside ballads, conduct books, and songs—to more closely investigate the discourses and performances of drinking culture. Drinking culture, I argue, not only had a significant role in shaping the Restoration's civic culture of political participation and the emerging early modern public sphere, but also positioned emotions of pleasure and melancholy as social and political objects of care and cultivation. While the politics of pub culture and intoxication have been well documented by historians and literary scholars of early modern England and eighteenth-century America, much of this discussion has not yet been incorporated into political assessments of the public sphere and its history. Reinserting emotion and intoxication into the emergence of the public sphere helps to flesh out the history of feeling and social ritual in civic engagement.

When discussing the preconditions of liberal Islamic politics, liberal theorists often advocate the reinterpretation of traditional religious texts in light of liberal political theory. Such an interpretive project is worth comparing to a similar project conceived by the medieval Islamic philosopher Alfarabi, whose effort to introduce Greek political philosophy into his political-religious community parallels these efforts to introduce liberal theory into Islamic communities. Alfarabi argued that traditional texts should be reinterpreted in light of a new political science, one based on Greek sources but adapted to the unique needs of a community like his. This article shows how Alfarabi conceived of these adaptations, emphasizing the flexibility that he thought students of Greek political philosophy should adopt in accommodating even Islamic doctrines that they could not fully accept.

This paper sets out diverse ways that Shakespeare's dramas can be read politically. Critics and political theorists have often concentrated on what Shakespeare said about politics—whether he was broadly republican or monarchist, protofeminist or a patriarchalist—as well as concentrating on his references to political themes of his day. Focusing on political readings of Merchant of Venice and Othello, I argue that, rather, we should pay attention to how Shakespeare plays with numerous styles of political action and role, from statesmanship and the competiton for state office or for sovereignty, to the everyday relations of kinship and friendship that interact with state government and law, and to individuals' struggles against politically established power—patriarchy, class, state law—that constrains or oppresses them. The figure of the Machiavellian political operator, whether acting for good or for ill, is contrasted with the open speaker of truth in public.

In Nietzsche's early and late writings, he appears as an antimodern, antiliberal political revolutionary, championing the world-transformative characters of (first) Richard Wagner and (later) Zarathustra. By contrast, in the writings of his “middle period,” Nietzsche struck up a rapprochement with the modern world, and developed the ideal of a “free spirit.” Among those writings, The Wanderer and His Shadow sheds the most revealing light on the free spirit ideal. It shows that, even as Nietzsche sought to avoid some of the hazards associated with his more revolutionary writings, he continued to advocate a sharply critical engagement with political and cultural life. And it reveals what Nietzsche understood to be most challenging or problematic about the free spirit ideal—and, thereby, what later moved him away from it.

This paper defends the traditional distinctive notion of the common good against the claim that it is normatively redundant on the aggregative conception. The first two sections of the paper outline the different candidate conceptions of the common good and the normative role of the common good within natural law theories. The paper then considers some difficulties faced by the instrumental and aggregative conceptions, before developing an Aristotelian account of the distinctive conception of the common good and demonstrating its normative significance for a natural law account of political and legal authority.

This article examines Reinhold Niebuhr's contributions both to twentieth-century liberalism and to reflection on liberalism's relationship to political ethics. These contributions are, I argue, twofold. First, Niebuhr's account of moral psychology chastens liberal ambitions and assumptions, offering a more “realistic” liberalism (while avoiding certain weaknesses of “realist” theories). Second, Niebuhr's thought points to the importance of ethos—the combination of dispositions, temperament, and perceptions that shape individual conduct—in defining liberalism and determining the quality of political action. In articulating an ethos of humility, moderation, skepticism, irony, and self-restraint, Niebuhr offers a reformulation and defense of liberalism, and a warning against dangers that threaten liberalism both from within and without.

Shakespeare's Troilus and Cressida is a notoriously bleak and problematic play: a dark comedy, a witty tragedy, an X-rated romance. A love story set during the Trojan War, the play appears to treat both love and war with utter cynicism. Ulysses drives the plot, craftily luring a despondent Achilles back onto the battlefield, and exposing Troilus to the betrayal of his beloved Cressida. A world-class manipulator and debunker of love and honor, Ulysses casts a shadow over this sour play, though he seems curiously unaffected by his skeptical outlook. A few critics have argued that Ulysses is the hero of Troilus and Cressida, a clear-sighted philosopher who may well speak for Shakespeare himself. I will argue against that view. I will also suggest that Troilus, if not the hero of this play, is perhaps its only sympathetic character.

Recent interpretations of Rousseau suggest that autonomy is the master concept by which to understand his justification of the state. The Rousseauian state is legitimate insofar as it enables individuals to obey only their own wills and thus to be free. Autonomy-based interpretations cannot adequately account for Rousseau's remarks on the role of the state in securing a collective form of happiness through political community. These interpretations incorrectly construe collective happiness as pertaining only to how civic-minded citizens might be psychologically motivated to obey the state's dictates, rather than to what makes the state legitimate. By contrast, I offer a new interpretation according to which the Rousseauian state is justified because it enables a mutually constitutive relationship between the autonomy of individuals and the happiness that stems from participation in political community.

While numerous methodological and interpretive challenges confront the study of cross-cultural political theory, this essay examines a particular premodern Indian tradition as an example of such difficulties and one way in which they can be overcome. Exploring the problematic ways in which people have interpreted and made use of India's ancient past, it critically examines arguments for the existence of secularism, free elections, and democratic assemblies in the Vedas. Defending what I call a “critical revivalist” position, it is argued that predominant approaches to premodern traditions in contemporary Indian political theory place significant constraints on cross-cultural intelligibility and theory building within the Indian context. To elaborate this point, I shift from a “political” to rājan-oriented categorical register in an effort to reposition current understandings of self-rule (swaraj) in India within a broader rajanical tradition. Finally, this essay explains how contemporary Indian political theory can draw insights from this native tradition without necessarily reverting to familiar Western idioms.

Pericles famously described the Athenians as “lovers of the beautiful with thrift, and lovers of wisdom without softness.” Yet he cautioned that Athens's pursuit of boundless empire and glory could corrupt the citizens and destroy Athenian brilliance. Timon of Athens, the counterpart of A Midsummer Night's Dream, depicts what Pericles had warned against. The Athenians' love of the noble has given way to a voracious love of gold. With artists looking upon their work as merchandise to be sold at the highest price, the only thing considered beautiful is a line of salacious chorus-girls. Flattery and utility prevail throughout. The lowest form of friendship is thought to be the highest. Athens has disintegrated as a community of citizens sharing a common heritage. And philosophy, no longer a speculative inquiry, has become a shameless way of life, based on a fixed doctrine and virtually indistinguishable from misanthropy.

The essay discusses the interpretation of Aristotle's natural right teaching by Leo Strauss. This interpretation ought to be seen as the result of an investigation into the history of philosophy and of an attempt to philosophically address political problems. By virtue of this twofold origin, the Straussian commentary is unorthodox: it deviates from traditional Aristotelianism (Aquinas and Averroes) and it seems alien to the text of the Nicomachean Ethics. Strauss's criticism of medieval variants results from their incapacity—shared by contemporary political thought—to address a perplexing issue: political exception. He sees in Aristotle's political teaching a way to escape from this failure: the unification, in natural right, of the requirements of statesmanship and ethics. The discovery of this way allowed Strauss to produce an interpretation of natural right that articulates important points pertaining to Aristotelian political science.

Through a critical analysis of the positions of Rawls and Habermas, the article argues against the proviso that religious language be “translated” into an allegedly neutral vocabulary as a condition for full inclusion within public political reasoning. Defending and expanding the analysis of Maeve Cooke, it maintains that both Habermas and Rawls mischaracterize the nature of religious reasons in relation to reasons alleged to be “freestanding,” “secular,” or “postmetaphysical.” Reflection on the origins of religious discourse and the component thought to be retained when such discourse is “translated” demonstrates the untenability of a sharp distinction between “rational” and “religious” discourse on matters pertaining to morality. The article nonetheless affirms the need for common acceptance of the justificatory language of coercive political policies, but contends that this language is best conceived as a historically evolving wide (not universal) agreement, and as a confluence of various types of agreement.

For nearly half a century democratic citizens have been preoccupied with the search for self-respect. Though classical liberalism places this question outside its purview and many commentators see in such a concern evidence of a “thin-skinned” political culture, John Rawls has recently provided serious arguments for the political relevance of self-respect. These arguments, we claim, are deeply indebted to the social and political theory of Jean-Jacques Rousseau, whose deep albeit underexamined influence on Rawls shows itself both in Rawls's conception of the social problem as well as in his solution to it. Rawls's belief that the provision of self-respect can solve the social problem is uniquely Rousseauan not only because of its emphasis on equality but also because it suggests political life can and must reconcile the conflicts between self and society at a fundamental level.

This essay provides a contextual reading of Titus Andronicus, paying close attention to the play's collaborative authorship. Peele and Shakespeare are shown to have manufactured a superficially compelling but in reality utterly fake image of the Roman state as an imaginary laboratory for political ideas, especially the elective principle. Topical allusions and deliberate anachronisms encourage the audience to relate the subject matter to the present, viz., late Elizabethan England in the throes of a succession crisis and rent by confessional divisions. Unlike Peele's solo works, which exhibit a potent anti-Catholic bias, Titus remains confessionally elusive. The play invites the audience to reflect on the viability of particular modes of succession without committing itself either way, and shows that it is not institutional structures and processes but those who use and abuse them that make the difference to the state of the polity.

In the debate about the legitimacy of judicial supremacy, Cooper v. Aaron, the Little Rock desegregation case, is identified by both sides as critical to their argument. Defenders insist that Cooper exemplifies the need for a final authority in matters constitutional. Critics argue that the Court was wrong as a matter of democratic theory or empirical reality. In this article I argue that while it is true as a matter of empirical reality that the Court's interpretation is not the final word, the Court's assertion can be defended nonetheless. Relying on archival sources from the case, I explore the conditions under which the Court made the claim. To defend Cooper, however, does not require the defense of all assertions of judicial supremacy. I conclude by offering a preliminary analysis of how we might distinguish between more legitimate assertions of judicial supremacy and less legitimate ones.
