Where to Look for Your Treaties2

Published online by Cambridge University Press:  13 February 2019

Extract

Much of the immense bibliographical problem involved in the study and practice of international law is both predictable and inevitable, following as it does from the fact that the discipline is necessarily international. There is bound to be, that is to say, French, German, Italian and Roumanian documentation in relation to any matter in which the States of France, Germany, Italy and Roumania are equally concerned. Only occasionally are there linguistic, but still not necessarily textual, simplications where two States, such as Spain and Argentina or Australia and the United States, speak the same language. There was of course once a diplomatic tongue—first Latin, later French—with pretensions to universal application. But even in a monophone international society the multiplication of texts is not excluded as the term Notes identiques makes clear.

36 It may be noted that the present gaps in the “United Nations treaty series” are discontinuous. Thus volume 935, relating to the year 1974, appeared in 1977 although many of the volumes which should precede it have not yet appeared.Google Scholar

37 The League of Nations treaty series”, it is to be noted, reproduces rather fewer treaty texts than the number of items registered (4834) would suggest. Some such items, especially in the earlier years, consisted in mere ancillary instruments such as acts of denunciation. The number of pre-League treaties in the series is not considerable—under 200.Google Scholar

38. Volume of 175 of the “Consolidated treaty series”, the latest to appear takes the collection up to 1891. With volume 180 the series will enter the period covered by the Répertoire général of the “Institut Intermédiaire International” (see note 15 above), when it will be possible to introduce a measure of simplification and compression with respect to the remaining quarter of a century this series has still to cover. (By the time of going to press, vol. 185 (1897) had appeared).Google Scholar
