page 434 note 1 To avoid misunderstanding, it may be well to note that the sceptie is not bound to deny the restriction of the franchise, in Drakon's time, to the citizens who carried arms, and themselves provided the arms they carried (οἱ τ ὅπλα παρεχμενοι). But the crucial question is whether Drakon was the author of a new Constitution, and of a new Constitution which is fairly described in Άθ. πολ. 4. Is the authority or the argument of the Polity enough to carry that conclusion? I trow not.
