Recent jurisprudence in investment arbitration, almost all of which originated in disputes arising out of Argentina’s turn-of-the-century fiscal crisis, has raised difficult questions about the existence, nature, and advisability of necessity as a defense to state responsibility. The jurisprudence has contributed to a sophisticated literature focusing on necessity’s role in the special context of investment arbitration. But the growing prominence of necessity pleas in international law has not been so limited. Nor will its effects be. In the first place, investor-state arbitral jurisprudence contributes to the evolution of general international law. Investment tribunals invoke the latter, for example, to inform their interpretation of bilateral investment treaties (BITs) or to cure lacunae in the law. More significantly, beyond the realm of investment arbitration, the past few decades have seen a striking growth in necessity pleas in fields ranging widely across the landscape of international law.

During the last twenty years, the world has experienced a sharp rise in the number of international courts and tribunals, and a correlative expansion of their jurisdictions. These occurrences have dramatically affected and will continue to affect the fields of international law and international relations. The creation and operation of international judicial bodies that are capable of enforcing international commitments, interpreting international treaties, and settling international conflicts have facilitated the growth of international legal norms and cooperative regimes governing important areas of international law and politics, such as economic relations, human rights, and armed conflicts. International courts — understood in this article as independent judicial bodies created by international instruments and invested with the authority to apply international law to specific cases brought before them — have thus become important actors as well as policy instruments in the hands of international lawmakers. Such courts serve, in some respects, as the lynchpin of a new, rule-based international order, which increasingly displaces or purports to displace the previous power-based international order.

There is a new empirical turn in international legal scholarship. Building on decades of theoretical work in law and social science, a new generation of empirical studies is elaborating on how international law works in different contexts. The theoretical debate over whether international law matters is a stale one. What matters now is the study of the conditions under which international law is formed and has effects. International law is the product of specific forces and factors; it accomplishes its ends under particular conditions. The trend toward empirical study has expanded through the efforts of scholars in multiple disciplines, with legal scholars playing central roles independently and as collaborators in generating new empirical work. Legal scholars are also now pressed to be increasingly sophisticated consumers of this work. It is time to take stock and evaluate this new generation of multidisciplinary, multimethod empirical scholarship.

One of the most dramatic moments in twentieth-century international law transpired in 1999 when the House of Lords denied immunity to Augusto Pinochet, the former dictator of Chile. The “breathtaking” judgment cleared the way for the possible prosecution of Pinochet in Spanish national courts on charges of torture committed during his rule. By limiting immunity, the House of Lords’ rulings turned the world “upside down” and ushered in a new era of accountability for egregious violations of human rights. At least that is the prevailing narrative, one that pits accountability against the international law of immunity and sees Pinochet as a watershed moment in that struggle.

Albania ranks among the smallest and poorest countries in Europe, located on the Adriatic and Ionian Seas just north of Greece. It gained its independence from the Ottoman Empire in 1912 (accounting for the fact that a majority of the population is Muslim) and subsisted as a monarchy for much of the interwar period. Albania was occupied by Italy (and then Nazi Germany) for all of the Second World War. Communist partisans expelled the Germans in 1944, without the assistance of Soviet forces, and thus began nearly a half-century of a totalitarian, isolationist rule by an extremely repressive Communist regime under the leadership of Enver Hoxha and Ramiz Alia. This regime was definitively overthrown in 1991. Since that time, Albania has been periodically wracked by civil and political unrest, leading to substantial violence in 1997 that was quelled only with the brief deployment of a UN multinational protection force.

In debates over the scope of the Alien Tort Statute (ATS), one historical document has played an especially prominent role. That document is a short opinion by U.S. Attorney General William Bradford, issued in the summer of 1795, concerning the involvement of U.S. citizens in an attack by a French fleet on a British colony in Sierra Leone. In the opinion, Bradford concluded that “[s]o far ... as the transactions complained of originated or took place in a foreign country, they are not within the cognizance of our courts; nor can the actors be legally prosecuted or punished for them by the United States.” He also expressed the view that the actors could be prosecuted for crimes on the high seas, while noting that “some doubt rests on this point” in light of the language of the relevant criminal statute. Finally, he stated—in an obvious reference to the ATS—that

The Bradford opinion contains one of the few early historical references to the ATS, so it not surprisingly has received a lot of attention. Numerous academic articles, judicial opinions, and litigation briefs have invoked the Bradford opinion, for a variety of propositions. Reliance on the opinion has increased since the Supreme Court’s 2004 decision in Sosa v. Alvarez-Machain, in which the Court cited the opinion in support of the proposition that the ATS provides jurisdiction over certain common law causes of action derived from the law of nations. As an illustration of its perceived significance, both sides discussed the opinion in the oral argument before the Supreme Court in the first hearing in the pending ATS case, Kiobel v. Royal Dutch Petroleum Co.

The discipline of political science has developed an active research program on the development, operation, spread, and impact of international legal norms, agreements, and institutions. Meanwhile, a growing number of public international lawyers have developed an interest in political science research and methods. For more than two decades, scholars have been calling for international lawyers and political scientists to collaborate, and have suggested possible frameworks for doing so. Some prominent collaborations are under way—sharing research methods and insights.

There has been an ongoing debate over recent years about the scope of a state’s right of selfdefense against an imminent or actual armed attack by nonstate actors. The debate predates the Al Qaeda attacks against the World Trade Center and elsewhere in the United States on September 11,2001, but those events sharpened its focus and gave it greater operational urgency. While an important strand of the debate has taken place in academic journals and public forums, there has been another strand, largely away from the public gaze, within governments and between them, about what the appropriate principles are, and ought to be, in respect of such conduct. Insofar as these discussions have informed the practice of states and their appreciations of legality, they carry particular weight, being material both to the crystallization and development of customary international law and to the interpretation of treaties.

Much of the recent debate about the status of customary international law in the U.S. legal system has revolved around the alien tort provision of the Judiciary Act of 1789, currently section 1350 of Title 28. In Filártiga v. Peña-Irala, the decision that launched modern human rights litigation in the United States, the Court of Appeals for the Second Circuit relied on the view that customary international law has the status of federal common law in upholding section 1350’s grant of federal jurisdiction over a suit between aliens. The court’s position that customary international law was federal law was the prevailing view at the time—a view that has subsequently been dubbed the “modern position.” It was the view set forth in the black letter of the Restatement (Third) of Foreign Relations Law. Filártiga triggered a revisionist challenge to the modern position, with revisionists arguing that customary international law has the status of federal law only if given that status through statute or treaty, or perhaps through sole executive action; in the absence of such incorporation, customary international law has, at best, the status of State law in our legal system.

The international landscape on the regulation of domestic work is changing dramatically. At the hundredth session of the International Labour Conference (ILC) in June 2011, the International Labour Organization (ILO) adopted the historic Decent Work for Domestic Workers Convention, 2011 (No. 189) and accompanying Recommendation No. 201. These new international labor standards come sixty-three years after the ILO adopted its first resolution on the conditions of employment of domestic workers and forty-six years after its second such resolution, which recalled the "urgent need" for standards "compatible with the self-respect and human dignity which are essential to social justice" for domestic workers. The robust, comprehensive international norms were adopted after two decades in which the ILO's standard setting has been deeply criticized and its tripartite structure repeatedly challenged to become more representative. Since additional critique of the ILO standards system emerged at the ILC's 101st session in 2012, it would be an overstatement to suggest that the new instruments reflect an unequivocally positive trend in standard setting. Even so, they offer a critical realist basis for considering that ILO standard setting remains salient and that international social dialogue remains possible.

Although careful scholarly treatment of the history of international law is now thriving, within U.S. courts that history now begins with one eighteenth-century treatise published in Neuchâtel, Switzerland, in 1758 and published in translation for modern readers under the aegis of the Carnegie Endowment for International Peace in 1916. This treatise is Emer de Vattel’s Droit des gens ou principes de la loi naturelle, appliqués à la conduite et aux affaires des nations et des souverains. My aim in this article is to appraise the elevation of Vattel to vaunted originalist heights in U.S. law. The claim that Vattel’s theory of the law of nations completely represents how the Founding Fathers (Founders) understood the law of nations should be rejected as a matter of history.

The International Court of Justice issued its judgment on the merits in the case of Military and Paramilitary Activities in and Against Nicaragua on June 27, 1986. A public discussion to mark the twenty-fifth anniversary of the rendering of that judgment took place in The Hague on June 27, 2011. The meeting—“The Nicaragua Case 25 Years Later: Its Impact on the Law and the Court”—was arranged with the participation of individuals involved in the formulation and presentation of Nicaragua’s case. A diversity of views was expressed on whether the Court had jurisdiction in the case and on elements of its judgment on the merits, but the mood of the Hague session was celebratory.

One year ago, the U.S. Supreme Court refused a request by the Obama administration to stay the lethal injection by Texas of a convicted prisoner even though that execution would violate a U.S. treaty obligation. Instead, the Supreme Court deferred to contravening Texas state law and policy that denied the prisoner, Humberto Leal García, a hearing on the merits as to whether the government of Texas’s failure to advise Leal of his right to meet with a consular representative prejudiced his criminal convictions in Texas courts. The State of Texas, which opposed the stay, carried out the execution hours after the Supreme Court stood down.

Judge Stephen Schwebel has every right to attack the International Court of Justice's judgment in the Nicaragua case and to defend his dissenting opinion. But he goes too far when he accuses Nicaragua of perpetrating a "fraud on the Court." A response is appropriate, especially from counsel cited by Judge Schwebel for "proposing, developing, and arguing Nicaragua's case."

Sri Lanka's civil war came to a bloody end in May 2009, with the defeat of the Liberation Tigers of Tamil Eelam (LTTE) by Sri Lanka's armed forces on a small strip of land in the island's northeast. The conflict, the product of long-standing tensions between Sri Lanka's majority Sinhalese and minority Tamils over the latter's rights and place in society, had begun in the mid-1980s and ebbed and flowed for some twenty-five years, leading to seventy to eighty thousand deaths on both sides. Government repression of Tamil aspirations was matched with ruthless LTTE tactics, including suicide bombings of civilian targets; and for many years the LTTE controlled large parts of northern and eastern Sri Lanka.
