3 Relying on Moser v. U. S. (1951), 341 U. S. 41, naturalization was allowed a Swiss national who in 1942 and 1944 had applied for relief as a neutral alien from being drafted in the United States, Petition of Berini, 112 F. Supp. 837 (E.D.N.Y., June 15, 1953). Naturalization was rejected where the neutral alien had in 1943 sought draft exemption and now claims that he could not speak English at the time, Petition of MiTanda, 111 F. Supp. 481 (E.D.N.Y., Apr. 8, 1953). Naturalization was denied because of an outstanding deportation order, in Banks v. U. S., 204 F. (2d) 583 (5th Cir., May 19, 1953). The problem of absence from the United States for more than one year during the statutory period, as a self-employed person, was before the court In re Nathan, 114 F.
