In 1865, the British Colony of Hong Kong extradited a Chinese shop-owner on a charge of piracy and incited a barrage of criticism when the offender was punished by the infamous “death by a thousand cuts” in Canton upon his rendition. Rumors surfaced identifying him as a rebel chief in the Taiping Rebellion (1850–1864). By excavating court records, diplomatic exchanges, and legal discourses surrounding this case, the article engages in a critical examination of extradition law and implementation in mid-19th century between Hong Kong and China. It examines how the case played into the politics of four administrative localities - Hong Kong, Canton, Beijing, and London - and uncovers the networks of agencies at play. It contributes to the history of extradition by contextualizing the “political offence exception” in international law and explains how this exception, ill-defined and vaguely conceived as it was, found its way into the implementation of Article 21 of the Treaty of Tianjin on the rendition of fugitives from Hong Kong to China, with a significant impact on the Qing's governance and jurisdiction of cross-border fugitives.

In February 1915, non-citizen teachers throughout California abruptly learned that they would soon lose their jobs when state officials announced that local and county governments were required to enforce a long-forgotten anti-alien public employment law. In response, one Canadian immigrant teacher, Katharine Short, launched a diplomatic, legal, political, and public relations campaign against the policy. Earning the support of powerful (Anglo-)Canadian nationalists in wartime and a favorable depiction in California news coverage as a “practically American” Canadian woman, Short’s efforts culminated in an exemption for most immigrant teachers from the state’s nativist public employment policies. This article recovers, recounts, and contextualizes the California Alien Teachers Controversy of 1915 at the center of transformations in the political development, law, and politics of American citizenship and citizenship rights from the late-nineteenth to mid-twentieth centuries. It testifies to the growing power and powers of state governments to shape immigrants' lives and livelihoods via alienage law long into the mid-twentieth century, the rhetorical strength and courtroom limits of “right to contract” arguments in the context of anti-alien hiring and licensure disputes, and the disparate impact of these nativist laws on immigrants owing to inequalities of race, gender, and class and how those inequalities shaped the less-than-inclusive aims and strategies of Katharine Short in her campaign to alter the state's nativist public employment policies.

On October 2, 2020, a newborn infant girl was discovered in the trash in an airport bathroom in Doha, Qatar. There was a rush to secure the infant's life, which was successful. There was a rush, also, to find the infant's mother, an effort that involved subjecting several women to intrusive physical examinations to determine if they had recently given birth, leading, eventually, to international outcry.

“Policing, Profits, and the Rise of Immigration Detention in New York's ‘Chinese Jails’” explains how Chinese exclusion law created a “detention economy” in upstate New York. From 1900–1909, Northern New York jails held thousands of Chinese migrants who had been apprehended by immigration authorities crossing the U.S.-Canada border, and had filed habeas corpus claims in district courts. While scholarship on Chinese Exclusion has addressed the legal battles around due process, it has overlooked the detention infrastructure that these claims produced. Because the federal immigration service had no detention facilities in the region, they “boarded out” Chinese detainees at local jails, paying counties a nightly rate for each migrant held. These contracts transformed Chinese migrants into a commodity for rural communities looking to secure federal cash, with four Northern New York counties constructing separate “Chinese Jails” in order to increase the number of Chinese migrants they could incarcerate. This article challenges the scholarship that has presented immigration detention as a Cold War era development, instead showing how communities profited off jailing migrants at the turn of the century. Through the case of U.S. v. Sing Tuck, I argue that immigration officials eventually turned to the courts to streamline deportations and reduce their need for jail space.

On September 21, 1976, former Chilean Ambassador and Minister Orlando Letelier drove to his job in Washington, DC, in his Chevelle, accompanied by his coworkers, Ronni Moffitt and Michael Moffitt. As the Chevelle veered off Massachusetts Avenue into Sheridan Circle, the bottom of the car exploded upward, blowing off Letelier's legs and killing him within minutes. A short time after that, at George Washington Hospital, Ronni Moffitt died from a severed carotid artery. Michael Moffitt, sitting in the back, survived with minor injuries. Most observers of the brutal dictatorship of Augusto Pinochet, which had overthrown Marxist President Salvador Allende in 1973 and jailed and then exiled Letelier, Allende's defense minister, pinned the crime on the Chilean despot, and the Departments of Justice and State came to the same conclusion within a few years. The assassination remains to this day the only instance of state-sponsored terrorism in Washington. In the 1970s and 1980s, it spawned several criminal lawsuits in the United States and Chile, the most important of which was not settled until 1995, and remnants of which continue to this day. In Chile, the case also inspired a wave of legal activism against impunity for human rights violations.

This article examines Zionist/Israeli comparisons and connections to India and Pakistan between 1945 and 1955. While Zionists found striking similarities between the unfolding realities in Palestine/Israel and South Asia, the exact nature of the comparison was quite equivocal. On the diplomatic axis, Israelis sought to establish full diplomatic relations with India by underscoring the similarity of their two nations. Here, comparisons were a way of positioning Israel as an analogue of India. On the technocratic axis, Israelis looked to Pakistan as a model for constructing legal institutions to expropriate Palestinian property. The appeal of Pakistan as a model was due to a perceived glaring difference: Pakistan was a Muslim state, Israel the Jewish State. Meanwhile, as Zionists/Israelis looked to India and Pakistan, Indians returned the gaze. Indian technocrats found the methods Israel used to resettle Jewish refugees and immigrants worthy of emulation. When they came to Israel to study these resettlement efforts, they were-unknowingly-often looking at projects that had been built upon former Palestinian land which the Israeli government had seized using the transplanted Pakistani law-the very same laws that had dispossessed India's new citizens, whom the technocrats were seeking to resettle. This article ultimately uncovers a broader post-imperial technocratic sphere in which nascent states continued to transplant legal institutions developed in other parts of the former colonial world to construct their own.

This article examines the intersection between extraterritoriality--privileges afforded to European subjects in the Islamic Mediterranean--and various forms of state membership. To capture the multiplicity and instability of state membership, I introduce the phrase “legal belonging”--a neutral, umbrella term that encompasses a wide range of bonds between individuals and states (usually referred to as subjecthood, nationality, or citizenship). Adopting the methods of global legal history, I look at how laws regulating legal belonging responded to the extraterritorial context of the Mediterranean in both European and Middle Eastern states. In so doing, I offer an alternative to the centrifugal narrative of modernization, which presumes that modern citizenship was invented in Europe and then exported to the Islamic world. Instead, I contend that the evolution of legal belonging on both sides of the Mediterranean developed in response to the challenges and opportunities presented by extraterritoriality. The article consists of two cases studies: first, I look at the regulation of legal belonging in Tunisia, the Ottoman Empire, and Morocco, arguing that this legislation responded to the challenges posed by extraterritoriality. Second, I examine the influence of extraterritorial regimes on the nationality of Algerians under French colonial rule.

The handling of infanticide in late medieval France offers modern audiences an underappreciated paradox: on the one hand infant murder was deplored as grave sin and crime, on the other hand, it was a pardonable offence, even the infanticidal singlemother who had killed to conceal her sin could obtain royal grace. This is far more than the usual story of law differing from practice. Christian ideology of mercy and forgiveness for sin played a central role in shaping the regulation of illegitimate births as well as abortions, stillbirths, and infanticide. Church and secular authorities alike sought to prevent as well as punish the death of infants, but they also created and implemented systems of justice with the explicit purpose of providing mercy to the repentant murderer, even an infanticide.

This article clarifies the precise connection between two early national Supreme Court decisions, the little-known Terrett v. Taylor (1815) and the landmark Dartmouth College v. Woodward (1819). The missing link between these cases is incorporation. Both disputes arose in the turmoil of post-Revolutionary disestablishment as state legislatures directly challenged the rights of colonial corporations. While Dartmouth College had been incorporated by a royal charter in colonial New Hampshire, the litigant in Terrett, a parish vestry, had been incorporated under common law in colonial Virginia. After the Revolution, Virginia's legislature disestablished the Anglican Church, disregarded its customary incorporation, revoked its post-revolutionary act of incorporation, and seized parish property. These radical policies set Virginia apart from other states and made these disputes a critical litmus test for the rights of all corporations. John Marshall opposed these policies while serving as a delegate in Virginia's legislature, and his views on these issues prefigured his opinion in Dartmouth College. Virginia's highest court upheld these policies as lawful, but the US Supreme Court's rejected them as unconstitutional in Terret. The Court's ruling in Terrett set a significant precedent for the standing of all private corporations vis-a-vis state legislatures and laid the groundwork for the Court's decision in Dartmouth College.

The history of Israel's relationship with its Palestinian-Arab minority during the founding decades, from 1948 to 1968, is often portrayed as a story of formal citizenship that concealed large-scale, state-sanctioned oppression under military rule. This article excavates an untold history of employment affirmative action for Palestinian-Arab citizens of Israel during these two decades which does not fit neatly into this story. Drawing on original archival research, it reveals that, during Israel's founding decades, officials adopted hiring quotas for unskilled Arab workers and for educated Arabs; requirements and incentives for hiring Arabs in government offices, Jewish businesses, and organizations; earmarked jobs and established vocational training courses for the Arab population. It demonstrates that interests in safeguarding Jewish control and economic stability aligned with egalitarian aspirations, and motivated state officials to adopt measures that promoted the inclusion of the Arab population in the workforce, albeit on unequal terms. Furthermore, these measures were part of a transformation of the state's attitude towards Arab citizens, from strict military control to a regime of “hierarchical inclusion” entailing gradual integration into the Israeli economy — mostly though its lower tiers and with a second-class status. Tracing the use of these mechanisms, not then called affirmative action but recognizable as such today, to this period of subjected population management, complicates our understanding of both this chapter in Israel's history and of affirmative action more broadly.

Taking mid-nineteenth century Belize as a case study, this article considers the role of migration in forming political, legal, and spatial geographies in a region with weak state institutions and disputed borders. The Caste War—a series of conflicts starting in 1847 in the southeastern Mexican state of Yucatán— resulted in the movement of thousands of people into the neighboring British settlement of Belize. This population movement reshaped the interface between the metropole and the settlement. This was a colony-defining moment in the development of Belize, leading to an extension of imperial control that eventually culminated in the transition to Crown colony in 1871. The refugee crisis was tied to broader Atlantic questions around asylum, law and empire. The benevolent treatment of refugees became the gauge of a “civilized” colony until the refugee crisis turned into a race crisis. This article examines how local administrators used a humanitarian discourse to enshrine white settler colonialism in a territory suddenly inhabited by a foreign-born multi-ethnic majority. The refugee label became a way to secure British sovereignty over the territory and its inhabitants, including non-British subjects, while extracting resources from the newcomers.

In 1869, the Cincinnati school board ended a forty-year tradition of Bible reading in the schools in an attempt to encourage Catholics to use them, thus provoking national controversy and a lawsuit brought by pro-Bible advocates. Scholars regularly cite the Ohio Supreme Court decision in favor of the school board as a landmark in the legal separation of church and state. This article interrogates the meaning of the secularization of law by examining expressions of juristic, pedagogic, and popular consciousness in the multiple levels and spaces where individuals raised and resolved constitutional questions on education. Dissenting Christian tradition shaped the legal brief of Stanley Matthews, the school board's lead attorney. Matthews' sacralized the religious liberty guarantee found in the Ohio Constitution within a post-millennialist framework. Ohio Chief Justice John Welch hybridized Christian dissenting tradition with deistic rationalism in <u>Board of Education v. Minor, et al</u>, thus appealing to as broad a constituency as had the right to elect justices to the Ohio Supreme Court. The limited, technical ruling allowed for a metropole/periphery divide in educational practice, so that Bible reading and prayer in Ohio public schools continued well into the 20th century. Far from a landmark in secularization of the law, the Bible War case demonstrates the persistent power of religion to frame law, including the law of religious liberty.

In August 1677, the Genevan consistory, a church court preoccupied with regulating sexual sin, summoned Louise Bouffa. Louise was a single woman recently hired by the wealthy Sarasin family as a wet nurse, an occupation that signaled to the consistory that she had recently given birth. The pastors and elders wanted to know who the father was and where the child was now. Louise was at first evasive. She claimed not to know the name of the father, although she did admit that the man with whom she had had sex was “very well dressed.” She said that she had given birth not far from Geneva, in the village of Gy, where the baby had been baptized and then had died. These claims turned out to be false. The Genevan consistory contacted the pastor in Gy who denied that her child had been baptized there. Summoned to tell the truth, Louise admitted that she had given the baby away to a man named Bertet to present as his own child for baptism, although she added that she was aware he had not done so. She also revealed that the father of the infant was a well-respected Genevan citizen and lawyer, Léonard Revillod, in whose household she had been working when she became pregnant. The consistory admonished Louise for lying about the baptism and sent her and her master to the criminal court to be prosecuted. This court, an elected body called the Small Council, duly fined Léonard for having had sex with his servant and for having “obliged her to give the baby to a stranger.” As for Louise, she was merely sent back to the consistory, which excluded her from participating in communion. No further investigation of the fate of the infant ensued.

The segregation laws known as “Jim Crow” are often understood as legislative efforts to promote White supremacy by shielding White southerners from contact with other races. This was not the case, however. By analyzing early railway segregation laws–in particular, the 1890 Louisiana law that was challenged in Plessy v. Ferguson–this article shows that the first post-Reconstruction segregations laws used an expansive definition of the “white race” as everyone who was not Black. In short, White purity and separation were the pretext, not the purpose, of early Jim Crow laws. Instead, the structure of legal segregation was initially determined by White, Democratic legislators' efforts to isolate and subjugate Black Americans by reinstating the racial logic of slavery, which had divided the world into Black people and everyone else. To achieve this end, White supremacist lawmakers framed laws that strategically integrated “white” train cars, all the while claiming the laws did the opposite.

“The Contradictions of Reform” analyses the complications of reform of legislation regulating punishment for women convicted of infanticide in Connecticut between 1790 and 1860, within the context of broader social, cultural, and legal understandings of the crime within the US. These changes are investigated through a close reading of petitions for clemency to Connecticut's General Assembly in which women convicted of the crime petitioned the state legislature seeking reduced sentences. The article argues that although the nineteenth century opened with legislation that promised death to all women convicted of infanticide, in practice courts and juries never imposed the penalty. Instead, juries proved reluctant to convict and/or death sentences were not imposed, even if juries found women guilty. In the early decades of the nineteenth century, the Connecticut Assembly reformed existing infanticide law in response to a number of social debates about the merits of the death penalty, particularly for women. The article argues, however, that these reforms counter-intuitively resulted in less favorable outcomes for those convicted of the crime, as they found themselves facing lengthy prison sentences. Such an outcome was unlikely in the early decades of the nineteenth century. The article, therefore, demonstrates, the “contradictions of reform.”

In the 1930s and 1940s, the conservative newspaper industry argued that the First Amendment should shield them from New Deal economic regulations. This article uses these forgotten clashes about freedom of the press to provide a new history of the origins and trajectory of the anti-regulatory First Amendment. It shows that conservative newspaper attorneys were at the forefront of efforts to use civil liberties to protect their economic interests in the New Deal. But it argues that these efforts were only partially successful. The courts rejected these maximalist First Amendment claims, distinguishing between economic liberties and civil liberties. But maximalist claims were more successful in the political culture, where conservative newspapers helped legitimize a belief that a laissez-faire “marketplace of ideas“ was a liberal principle with deep roots in the past. The origins of First Amendment Lochnerism thus lie not in judicial precedent, but in contestation in the political culture. A clearer understanding of the dynamics of this long-running effort to deploy civil liberties claims for conservative purposes, the article concludes, will help us better navigate the contemporary crises of the First Amendment.

In the years after independence, former British colonies in eastern and southern Africa struggled to fill the ranks of their judiciaries with African judges. Beginning in the mid-1960s, states including Uganda, Tanzania, and Botswana solved this problem by retaining judges from the Caribbean and West Africa, especially Nigeria. In this same period, a wave of coups brought many independent states under the rule of their militaries (or authoritarian civilian regimes). Foreign judges who had been appointed in the name of pan-African cooperation were tasked with interpreting the laws that soldiers imposed, and assessing the legitimacy of regimes born of coups. The decisions they rendered usually accommodated authoritarianism, but they could also be turned against it. To understand how colonial law and postcolonial solidarities shaped Africa's military dictatorships, this article focuses on one judge, Sir Egbert Udo Udoma of Nigeria, who served as Uganda's first African chief justice and was an influential member of the Nigerian Supreme Court. Udoma and other judges like him traversed the continent in the name of African cooperation, making a new body of jurisprudence as they did so. Their rulings were portable, and they came to underpin military rule in many states, both in Africa and in the wider Commonwealth.

Between the 1870s and the 1910s, municipal court officials in southernmost Mexico recorded contracts regarding small debts and credits in what they labeled libros de conocimientos. While only very rarely citing Mexico's new civil codes of the 1870s and 1880s, the contracts contained in these registers regularly engaged with the kinds of agreements, guarantees, and enforcement mechanisms laid out in the code. They also capture an active, if still elusive, quotidian credit market for the far from well-to-do. This article uses these registers to trace the creation and evolution of Mexico's civil code from the periphery of the country rather than its center. By looking at the ways farmers, smalltime merchants, housewives, and laborers made use of its forms and norms, we can see how liberal economic policy permeated society through use. The determination of everyday people to make good on the protections and possibilities of liberalized fiscal policy cemented that policy in everyday practice.
