Summary
The Coalition for Responsible Regulation opinion did not explain what it meant by a “precautionary, forward-looking scientific judgment.” As used by the court, the word “precautionary” actually has a special legal meaning originating in something called the precautionary principle. This chapter explains the origins and application of the precautionary principle underlying such a judgment.
