Summary
The Brazilian legal system
21.01The legal system of Brazil is, unlike common law systems, based on codified law, which in turn is based on the Federal Constitution of 1988. However, the influence of Anglo-American law is nonetheless considerable, as is the importance of the law created by the jurisprudence of Brazilian courts, which supplements written law.
21.02Brazil is divided into twenty-seven states, which in turn are divided into municipalities. Although each state has its own Constitution, the legislative and administrative powers of each member of the Federation, especially as regards certain areas, is given by the Federal Constitution of 1988, by which each state is bound.
