The Competition Act 2008
Merger control rules are stipulated in the Prevention of Restriction on Competition Act – ZPOmK-1 (hereinafter ‘the Competition Act 2008’). In addition to merger control rules, the Competition Act 2008 contains a prohibition against restrictive agreements and abuses of a dominant position. Merger control rules were previously contained in the Prevention of Restriction on Competition Act – ZPOmK (hereinafter ‘the Competition Act 1999’).
The Competition Act 2008 modernised the Slovenian merger control rules contained in the Competition Act 1999. Although the Competition Act 2008 was amended in 2009, the amendments did not concern merger control.
Governmental decrees
After the Competition Act 2008 came into effect, new governmental decrees were needed to reflect new developments and amendments.
With regard to merger control, the government adopted the Decree Deining the Contents of the Notiication Form for the Concentration of Undertakings.
Earlier decrees (Instructions on Procedures and Conditions for Deining the Relevant Market, and Decree Deining the Contents and Elements Required for the Notification Form Used for the Concentration of Undertakings5) were repealed.
