RELEVANT LEGISLATION AND STATUTORY STANDARDS
The Competition Act
The primary source of competition law in the Slovak Republic is the Competition Act (Act No 136/2001, Collection of Laws, hereafter ‘the Collection’), the latest amendment of which was enacted in 2009 (‘the Amendment 2009’).
The Competition Act contains the main rules relating to merger control, setting forth standards for the substantive assessment of concentrations as well as procedural rules. The Competition Act also defines the competences and powers of the Antimonopoly Office of the Slovak Republic (Slovak: Protimonopolný úrad Slovenskej republiky; ‘the Office’), the procedural rules applicable to proceedings conducted by the Office, and the sanctions for infringements of the competition rules.
Further legislation that may be of relevance in merger control proceedings includes the Act No 71/1967 Coll. on Administrative Proceedings (‘the Administrative Order’), the Act No 300/2005 Coll. Criminal Code (‘the Criminal Code’), the Act No 301/2005 Coll. Criminal Order (‘the Criminal Order’), the Act No 40/1964 Coll. Civil Code (‘the Civil Code’) and the Act No 99/1963 Coll. Civil Order (‘the Civil Order’).
