Chapter 16 raises the question about the appropriate role of EU competition law in addressing concerns with unfair trading practices (UTPs) in the food supply chain in the context of an integrated market. Taking a different, functional approach, looking outward to what other laws and policy instruments may achieve, it tests the boundaries of competition law and suggests a possible way forward, should the scope of competition law not accommodate broader concerns that may require some additional regulatory intervention in different forms, such as sector-specific legislation on unfair trading practices, or other corrective measures, such as subsidisation, can provide the needed solution.
