  • Summary

    This chapter discusses the emergence of crimes against humanity, the main definitional features, and the most important jurisprudence on crimes against humanity. The chapter reviews historic references, the Nuremberg Charter, and evolution through international jurisprudence. The chapter examines the meaning of ‘widespread or systematic attack directed against a civilian population’, including the controversy over the meaning of ‘civilian’ and the many controversies about the ICC Statute Article 7 requirement of a ‘state or organizational policy’. The chapter reviews the jurisprudence on the prohibited acts (also referred to as ‘inhumane acts’), including murder, extermination, enslavement, deportation, forcible transfer, imprisonment, torture, rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, other sexual violence, persecution, forced disappearance, apartheid, and other inhumane acts.

  • What norms apply to the determination of lawful targets? What persons and objects may be lawfully targeted in armed conflict? What are the reasons, both legal and extra-legal, of civilian losses? What principles must be observed when attacking military objectives? How can the protection of persons who are not participating in hostilities can be strengthened? Is it possible to develop a consistent approach to targeting in armed conflict regardless of the legal qualification of the armed conflict? This monograph answers these questions and many more. Taking into account both military objectives and civilian objects, it considers the extent of their protection in a range of contexts, providing an essential source of reference for scholars dealing with issues across international humanitarian law and armed conflict.

  • What is it like to be working in the field with international humanitarian law during an armed conflict? In the article ‘International Humanitarian Law from a field perspective - case study: Nepal‘, the promotion of international humanitarian law is described through the eyes of a humanitarian aid worker. The author worked as a delegate for the International Committee of the Red Cross (ICRC) during the civil war in Nepal. International humanitarian law forms the legal basis of the ICRC's presence in Nepal, it's humanitarian activities and confidential interventions. Nepal and its conflict are introduced, as well as the warring parties and the Red Cross in Nepal. Various humanitarian activities and dilemma's are described. Through this article the YIHL seeks to link theory and practice, and focus on international humanitarian law from an operational perspective.
